The European Court of Human Rights has handed down several judgments on the subject, 14 of which found a violation, 4 of which concerned an alleged violation of article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms for expulsions enforcing a judicial decision and 10 concerned administrative expulsions.
وأصدرت المحكمة الأوروبية لحقوق الإنسان عدداً من القرارات بهذا الشأن، استنتج في 14 قراراً منها حدوث انتهاك. وكانت أربعة من هذه القرارات تتعلق بانتهاك مزعوم للمادة 3 من اتفاقية حماية حقوق الإنسان والحريات الأساسية في عمليات الطرد التي تستند إلى قرار قضائي، وعشر منها بحالات طرد إداري.

These principles are a part of the rule-of-law principles anchored in the Basic Law as well as in article 6 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

That principle is embodied in article 4 of the Convention for the Protection of the Natural Resources and Environment of the South Pacific Region, otherwise known as the Noumea Convention.

She also claimed that the Supreme Court judgement violated article 6, paragraph 1 and article 14 of the Convention for the Protection of Human Rights and Fundamental Freedoms and article 1 of its Protocol as well as articles 1, 2 and 15 of the Convention on the Elimination of All Forms of Discrimination against Women.

In the judgement, passed by 16 votes to 1, the Court ruled that Turkey had violated 14 articles of the Convention for the Protection of Human Rights and Fundamental Freedoms, including the right to life, the right to liberty and security, the right to freedom of thought, and the right to freedom of expression.

This follows the practice of the European Court of Human Rights and in accordance with the more recent practice and view, there has been a broader interpretation of Article 6 paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms to the effect that the legal assistance shall also be granted in administrative proceedings.

It is a vivid example of forced labour banned unequivocally by all international human rights documents, including Article 8 of the Pact on Civil and Political Rights, Convention N 105 of the International Labour Organization and Article 4 of the Convention for the Protection of Human Rights and Fundamental Freedoms.

It further stresses that the administrative court of Orléans, in its decision of 25 August 2006, also carried out a thorough review with regard to article 3 of the European Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights), which covers the same area of protection as article 3 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.

In this regard, the statement made in article 13 (d) (ii) of the Convention for the Safeguarding of the Intangible Cultural Heritage, according to which access to cultural heritage should be ensured " while respecting customary practices governing access to specific aspects of such heritage " , cannot be interpreted as permitting gender-based discrimination (A/HRC/17/38, para. 76).
