Article 1 of the Optional Protocol clearly stated that a State party to the Optional Protocol recognized the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction.
وتنص المادة 1 من البروتوكول الاختياري بوضوح على أن الدولة الطرف في البروتوكول تعترف بصلاحية اللجنة فيما يتعلق بتلقي المراسلات من الأفراد الخاضعين لولايتها والنظر فيها.

The State party should consider establishing an independent mechanism, with authority to promptly, impartially and effectively investigate all reported allegations of and complaints about acts of torture and illtreatment from both individuals in pretrial detention at police facilities or penal institutions and inmates in penal institutions.
ينبغي أن تنظر الدولة الطرف في إنشاء آلية مستقلة تتمتع بسلطة التحقيق فوراً وبنزاهة وفعالية في جميع الادعاءات والشكاوى المقدمة بشأن أعمال التعذيب وإساءة المعاملة، من جانب كل من الأفراد الخاضعين للاحتجاز السابق للمحاكمة في مرافق الشرطة أو المؤسسات العقابية، ونزلاء المؤسسات العقابية.

2. Communications submitted by or on behalf of individuals or groups of individuals who are subject to the jurisdiction of a State party to the Convention and the Optional Protocol shall be subject to the provisions contained in articles 1 and 2 of the Optional Protocol and rule 55 et seq. of the Committee's rules of procedure.

4.6 On 25 January 2012, the State party submitted that upon becoming a party to the Optional Protocol, it had agreed, under article 1 thereof to recognize the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by the State party of any rights protected by the Covenant.

4. 4- وتنصّ المادة 1 من البروتوكول الاختياري على أن تعترف كل دولة طرف فيه باختصاص اللجنة في أن تتلقى البلاغات المقدمة من الأفراد الخاضعين لولايتها الذين يدّعون أنهم ضحايا انتهاك تلك الدولة الطرف لأي حق من الحقوق المقررة في العهد وأن تنظر في تلك البلاغات.

4. The Committee further observes that, by adhering to the Optional Protocol, a State party to the Covenant recognizes the competence of the Human Rights Committee to receive and consider communications from individuals subject to its jurisdiction claiming to be victims of a violation of any of the rights set forth in the Covenant.
وتلاحظ اللجنة كذلك أن تقيد دولة طرف في العهد بالبروتوكول يشكل اعترافاً بامتلاك اللجنة المعنية بحقوق الإنسان صلاحية أن تتلقى بلاغات من الأفراد الخاضعين لولايتها الذين يدعون أنهم ضحايا انتهاك أي حق من حقوقهم المنصوص عليها في العهد، وأن تنظر فيها().

With reference to article 1 of the Optional Protocol to the Covenant, it submits that the Republic of Belarus has recognized the competence of the Human Rights Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by that State party of any rights set forth in the Covenant.
وبالإشارة إلى المادة 1 من البروتوكول الاختياري الملحق بالعهد، تقول الدولة الطرف إن جمهورية بيلاروس قد اعترفت باختصاص اللجنة المعنية بحقوق الإنسان لتلقي وبحث البلاغات المقدمة من الأفراد الخاضعين لولايتها القضائية الذين يزعمون أنهم ضحايا انتهاك من جانب الدولة الطرف لأي حق من الحقوق المنصوص عليها في العهد.

4.6 In a note verbale dated 25 January 2012, the State party submitted that, upon becoming a party to the Optional Protocol, it had agreed under article 1 thereof to recognize the competence of the Committee to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by the State party of any rights protected by the Covenant.
4-6 وتؤكد الدولة الطرف، في مذكرة شفوية بتاريخ 25 كانون الثاني/يناير 2012، أنها عندما أصبحت طرفاً في البروتوكول الاختياري، قد اعترفت بموجب المادة 1 من هذا البروتوكول باختصاص اللجنة في استلام وبحث الرسائل المقدمة من الأفراد الخاضعين لولاية تلك الدولة الطرف والذين يدّعون أنهم ضحايا أي انتهاك من جانبها لأي حق من الحقوق التي يحميها العهد.

6. In its further submissions dated 8 July 2010 and 4 September 2010, the State party reiterates its position that it assumed obligations under article 1 of the Optional Protocol to receive and consider communications from individuals subject to its jurisdiction who claim to be victims of a violation by the State party of any of the rights set forth in the Covenant.
6- تكرر الدولة الطرف، في ملاحظاتها الإضافية المؤرخة 8 تموز/يوليه 2010 و4 أيلول/سبتمبر 2010، موقفها المتمثل في أنها التزمت بموجب المادة 1 من البروتوكول الاختياري بتلقي ودراسة البلاغات الواردة من الأفراد الخاضعين لولايتها الذين يدعون وقوعهم ضحية انتهاك الدولة الطرف لأي من الحقوق المنصوص عليها في العهد.

The Committee recalls that in acceding to the Optional Protocol, the State party recognized the Committee's competence to receive and examine complaints from individuals under the State party's jurisdiction.
وتذكِّر اللجنة بأن الدولة الطرف، بانضمامها إلى البروتوكول الاختياري، قد أقرت اختصاص اللجنة بتلقي الشكاوى المقدمة من الأفراد الخاضعين لولاية الدولة الطرف والنظر فيها.

27. The Committee notes that the State party has not yet acknowledged the competence of the Committee to receive and consider communications from individuals under its jurisdiction relating to provisions of the Covenant.
27- وتلاحظ اللجنة أن الدولة الطرف لم تعترف بعد باختصاص اللجنة في تلقي البلاغات المتعلقة بأحكام العهد الواردة من الأفراد الخاضعين للولاية القضائية للدولة الطرف والبت في هذه البلاغات.
