The author refers to paragraph 24 of general recommendation No. 19, according to which State parties should take appropriate and effective measures to overcome all forms of gender-based violence, whether by public or private act, and provide effective complaints procedures and remedies, including compensation, to victims.

45. In accordance with rules 31, paragraph 2, 34 and 37 of the rules of procedure of the Committee, an amendment to paragraph 57 (b) of general recommendation No. 30 was voted upon by roll-call, as no consensus could be reached.

5.8 The author adds that the State party continues to fail to provide a competent national tribunal, thus depriving her of equal protection under the law and just and favourable conditions of work, for purposes of paragraphs 7 (e) and (h) of general recommendation No. 19.

Concerning data collection, in paragraph 9 of general recommendation No. 34, it was underlined that States parties should " take steps to identify communities of people of African descent living in their territories, especially through the collection of disaggregated data on the population " .

In cases where indigenous communities have been deprived of their lands and territories traditionally owned, the Committee recommends that the State party take steps to return those lands and territories or to provide adequate reparation measures, in accordance with paragraph 5 of general recommendation No. 23 (1997) on the rights of indigenous peoples.
وفي حالة حرمان مجتمعات الشعوب الأصلية من أراضيها وأقاليمها التي كانت تمتلكها تقليدياً، توصي اللجنة بأن تتخذ الدولة الطرف خطوات لإعادة هذه الأراضي والأقاليم أو توفير تدابير جبر مناسبة وفقاً للفقرة 5 من التوصية العامة رقم 23(1997) بشأن حقوق الشعوب الأصلية.

In cases where indigenous communities have been deprived of their lands and territories traditionally owned, the Committee recommends that the State party take steps to return those lands and territories or to provide adequate reparation measures, in accordance with paragraph 5 of general recommendation No. 23 (1997) on the rights of indigenous peoples.

5.7 The author contends that the State party's perpetuation of gender myths also violates article 11 (1)(f) of the Convention, given that it constitutes a failure to protect the author's rights to health and safety in the workplace, considering that, under paragraphs 17 and 18 of general recommendation No. 19, sexual harassment is a major barrier to equality in employment and constitutes a health and safety problem.

In Vishaka vs. State of Rajasthan Supreme Court dealt on the definition of sexual harassment and this judgement is similar to the one defined in paragraph 18 of the general recommendation 19 of the CEDAW.
وفي قضية فيشاكا ضد المحكمة العليا لولاية راجستان بشأن تعريف التحرش الجنسي، وهذا الحكم يماثل الحكم الوارد في الفقرة 18 من التوصية العامة رقم 19 من الاتفاقية.

It is noteworthy that paragraph 16 of the general recommendation states that the measures should be designed and implemented on the basis of need, grounded in a realistic appraisal of the current situation of the individuals and communities concerned.
