573. Under article 14 of the International Convention on the Elimination of All Forms of Racial Discrimination, individuals or groups of individuals who claim that any of their rights enumerated in the Convention have been violated by a State party and who have exhausted all available domestic remedies may submit written communications to the Committee on the Elimination of Racial Discrimination for consideration.
٥٧٣ - بموجب المادة ١٤ من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، يجوز لﻷفراد أو جماعات اﻷفراد الذين يدعون انتهاك دولة طرف ﻷي حق من الحقوق الواردة في الاتفاقية والذين يكونون قد استنفذوا جميع سبل الانتصال الداخلية المتاحة أن يتقدموا إلى لجنة القضاء على التمييز العنصري برسائل خطية للنظر فيها.

4.3 The State party also argues that the communication is inadmissible because the author has failed to substantiate that he is a victim of a violation of any of the rights set forth in the Covenant so as to justify a claim under article 2 of the Optional Protocol.
٤-٣ كما تحتج الدولة الطرف بأن البلاغ غير جائز القبول ﻷن صاحب البلاغ لم يثبت أنه ضحية انتهاك أي من الحقوق الواردة في العهد بما يبرر تقديم طلب بموجب المادة ٢ من البروتوكول الاختياري.

وتشير إلى أنها بانضمامها إلى البروتوكول الاختياري تعترف باختصاص اللجنة، بموجب المادة 1 منه، بتلقّي بلاغات من أفراد خاضعين لولاية الدولة الطرف القضائية يدّعون أنهم ضحايا انتهاك من جانب الدولة الطرف لأي من الحقوق الواردة في العهد، وبالنظر في تلك البلاغات.

The first authorizes the Human Rights Committee to consider individual communications regarding any of the rights contained in the Covenant, and has been ratified by over 70 countries.
أولهما يخول للجنة المعنية بحقوق الانسان النظر في البلاغات الفردية المتعلقة بأي من الحقوق الواردة في العهد، الذي صدق عليه ما يزيد على ٧٠ بلداً.

Many of the rights contained in the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights have been violated by the Israel Defence Forces (IDF) in their actions against the Palestinian people.

136. A general concern of the Committee is that in regard to many of the rights under the Covenant the basic law allows for broadly defined exceptions to these rights and no information has been provided as to the way in which those exceptions have been incorporated in specific laws or as to whether their application is in conformity with the Covenant.
١٣٦ - وتشعر اللجنة بقلق عام ﻷنه فيما يتعلق بالكثير من الحقوق الواردة في العهد، يسمح القانون اﻷساسي باستثناءات واسعة التعريف من تلك الحقوق، ولم تقدم معلومات بشأن الطريقة التي تم بها إدراج تلك الاستثناءات في قوانين محددة أو ما إذا كان تطبيقها يتفق مع العهد.

3.10 Lastly, the author maintains that any violation of any of the rights enshrined in the Covenant entails the violation of the State's obligation to respect those rights, embodied in article 2, paragraph 1.
3-10 وفي الختام، تؤكد صاحبة البلاغ أن انتهاك الدولة الطرف لأي من الحقوق الواردة في العهد يعني إخلالها بالتزامها باحترام هذه الحقوق المنصوص عليها في الفقرة 1 من المادة 2.

٥٧٤ - بموجب المادة ١٤ من الاتفاقية الدولية للقضاء على جميع أشكال التمييز العنصري، يجوز لﻷفراد أو جماعات اﻷفراد الذين يدعون انتهاك دولة طرف ﻷى حق من الحقوق الواردة في الاتفاقية والذين يكونون قد استنفدوا جميع طرق الرجوع المحلية المتاحة أن يتقدموا إلى لجنة القضاء على التمييز العنصري برسائل خطية للنظر فيها.

The ratification of the two International Covenants on Human Rights in 1992 and the adoption of the new Constitution guaranteeing many of the rights embodied in the International Convenant on Economic, Social and Cultural Rights in 1992 and of the new Labour Code in 1993 are highly appreciated developments.
والتصديق على العهدين الدوليين الخاصين بحقوق اﻹنسان في عام ٢٩٩١ واعتماد دستور جديد يكفل عددا كبيرا من الحقوق الواردة في العهد الدولي الخاص بالحقوق الاقتصادية والاجتماعية والثقافية في عام ٢٩٩١ واعتماد قانون العمل الجديد في عام ٣٩٩١، جميعها تطورات تحظى بتقدير كبير.
