15. The new protocol could be drafted to enter into force either after a certain number or a certain percentage of States parties to the Covenant have ratified it in accordance with their domestic procedures and deposited instruments of ratification, acceptance, approval, accession or consent to be bound with the Secretary-General.
15- ويمكن صياغة البروتوكول الجديد ليبدأ نفاذه إما بعد تصديق عدد معين أو نسبة معينة من الدول الأطراف في العهد عليه وفقاً لإجراءاتها المحلية وإيداعها صكوك التصديق أو القبول أو الإقرار أو الانضمام أو الموافقة على الالتزام به لدى الأمين العام.

Such a method would be based on the non-objection over a specified period of time of one or more than a certain percentage of States parties to the Covenant (one third, for example), rather than through a proactive method (such as signature subject to ratification, acceptance, approval, etc.).
وسيقوم هذا المنهج على مبدأ عدم اعتراض دولة طرف أو أكثر من نسبة معيّنة من الدول الأطراف في العهد (الثلث مثلاً) في غضون فترة زمنية محددة بدلاً من اتباع منهج مباشر (مثل التوقيع رهناً بالتصديق أو القبول أو الإقرار، إلخ.).

As to the Committee's argument therein that, " an increasing number of States parties to the Covenant, which have retained compulsory military service, have introduced alternatives to compulsory military service " , the State party points out that the legal systems of Germany and Taiwan Province of China, where alternatives have been introduced, are quite different from those of the State party.
ففيما يتعلق بقول اللجنة " إن عدداً متزايداً من الدول الأطراف في العهد التي أبقت على الخدمة العسكرية الإلزامية قد اعتمد خدمات بديلة لأداء تلك الخدمة " ، تشير الدولة الطرف إلى أن النظامين القانونين لألمانيا ومقاطعة تايوان الصينية، وهما بلدان أخذا بالخدمات البديلة، هما نظامان مختلفان كثيراً عن نظام الدولة الطرف.

2. The Committee may also transmit to the Economic and Social Council the comments referred to in paragraph 1 of this rule, together with copies of the reports it has received from the States parties to the Covenant and the observations, if any, submitted by them.
٢- يجوز للجنة أيضا أن تحيل إلى المجلس الاقتصادي والاجتماعي التعليقات المشار إليها في الفقرة ١ من هذه المادة، مشفوعة بنسخ من التقارير التي تلقتها من الدول اﻷطراف في العهد ومن الملاحظات، إن وجدت، المقدمة منها. سادس عشر ـ اجراءات النظر في البلاغات الواردة

No communication shall be received by the Committee if it concerns a State Party to the Covenant which is not a party to the present Protocol.
لا يجوز للجنة تلقي أية رسائل تتعلــق بأيــة دولة من الدول اﻷطراف في العهد لا تكــون طرفا في هذا البروتوكول.
