Article 236 of the Criminal Code is particularly explicit in this regard, since it punishes " adultery by the husband or the wife " without making any distinction.

The specific pieces of legislation in which the prohibition was set out were article 5 of the Penal Code, which established a range of principal and supplementary penalties, and the Press Code.

By the 1993 reform, the legislature abrogated article 207 of the Criminal Code, which granted extenuating circumstances to a husband who killed his wife on discovering her in the act of adultery.

By decision No. 788 of 2 April 2002, the Tunis Court of Appeal sentenced a police officer to 15 years in prison for deliberate assault and involuntary homicide under article 208 of the Criminal Code.

By decision No. 2,645 of 12 March 2005, the Tunis Court of Appeal sentenced three police officers to prison terms ranging from 12 to 18 months for acts of violence by public officials in the performance of their duties, under article 101 of the Criminal Code.

- Article 165 of the Criminal Code establishes a penalty of imprisonment for a term of six months and a fine of 120 dinars for anyone who hinders or disrupts the practice of religion or religious ceremonies, without prejudice to the more severe penalties incurred for insults, assault or threats.

157. Decision No. 1120 of 25 January 2002 by the Tunis Court of Appeal: three prison officers were sentenced, under articles 218 and 219 of the Criminal Code, to four years in prison for acts of violence against an inmate, causing permanent disability of more than 20 per cent.
157- القرار رقم 1120 الذي أصدرته محكمة الاستئناف بتونس بتاريخ 25 كانون الثاني/يناير 2002 الذي أدانت فيه ثلاثة أعوان سجون بأربع سنوات سجناً لتورطهم في إساءة معاملة أحد السجناء انجر عنه عجز دائم تجاوزت نسبته 20 بالمائة وذلك تطبيقاً للفصلين 218 و219 من المجلة الجنائية.

164. Decision No. 2645 of 12 March 2005 by the Tunis Court of Appeal: three police officers were sentenced to prison terms ranging from 12 to 18 months for acts of violence by public officials in the performance of their duties under article 101 of the Criminal Code.
164- القرار رقم 2645 الذي أصدرته محكمة الاستئناف بتونس بتاريخ 12 آذار/ مارس 2005 الذي أدانت فيه ثلاثة أعوان شرطة بأحكام تتراوح بين سنة و18 شهراً سجناً لأعمال العنف المرتكبة من قبل موظف عمومي حال مباشرته الوظيف وذلك تطبيقاً للفصل 101 من المجلة الجنائية.

The Act of 12 July 1993 amending article 218 of the Criminal Code treats the marital relationship as an aggravating circumstance that warrants a harsher penalty.
والقانون المؤرخ 12 تموز/يوليه 1994، المعدل للفصل 218 من المجلة الجنائية يعتبر رابطة الزوجية ظرفاً مشدداً يبرر تشديد العقوبة.

By decision No. 10,372 of 2 February 2007, the Tunis Court of Appeal sentenced a police station chief to a fine of 500 dinars for acts of violence by a public official in the performance of his duties under article 101 of the Criminal Code.
:: في الحكم عدد 10372 المؤرخ 2 شباط/فبراير 2007، أدانت محكمة الاستئناف بتونس رئيس مركز شرطة بغرامة قدرها 500 دينار بسبب العنف الذي ارتكبه موظف عام أثناء أدائه مهامه بمقتضى الفصل 101 من المجلة الجنائية.

12. While noting with satisfaction that article 101 bis of the Criminal Code prohibits torture, the Committee is concerned by reports that, in practice, confessions obtained through torture are not excluded as evidence in a trial.
12- ومع أن اللجنة تلاحظ مع الارتياح أن الفصل 101 مكرر من المجلة الجنائية يمنع التعذيب، فإنها تعرب عن قلقها إزاء معلومات تشير إلى أن الاعترافات المنتزعة تحت التعذيب، لا تستبعد من الناحية العملية من أدلة إثبات في المحاكمات.

44. In accordance with Law No. 89 of 2 August 1999, a new form of punishment has been introduced to Article 5 of the Criminal Code under the title " community work " .
44- تمّ بموجب القانون رقم 89 لسنة 1999 المؤرّخ 2 آب/أغسطس 1999 إقرار عقوبة جديدة أُدرجت ضمن العقوبات الأصلية بالفصل 5 من المجلة الجنائية وهي عقوبة " العمل لفائدة المصلحة العامة " .

162. Decision No. 1546 of 3 April 2002 by the Tunis Court of Appeal: a National Guard officer was sentenced to 16 months in prison for acts of violence resulting in permanent disability of more than 20 per cent under articles 218 and 219 of the Criminal Code.
162- القرار رقم 1546 الذي أصدرته محكمة الاستئناف بتونس بتاريخ 3 نيسان/ أبريل 2002 والذي أدانت فيه عون حرس وطني بالسجن 16 شهراً لتعديه بالعنف على أحد الأشخاص مما سبّب له عجزاً دائماً تجاوزت نسبته 20 بالمائة وذلك تطبيقاً للفصلين 218 و219 من المجلة الجنائية.

55. Replying to questions concerning torture, he confirmed that torture was a punishable offence under articles 218 and 219 of the Penal Code. Any State official found guilty of violating the physical integrity of a detainee was liable to a minimum of five years' imprisonment.
٥٥- ورداً على اﻷسئلة المتعلقة بالتعذيب، أكد السيد الناصر أن التعذيب جريمة تستوجب العقاب بمقتضى المادتين ٨١٢ و٩١٢ من المجلة الجنائية وأي مسؤول بالدولة يثبت أنه مذنب بانتهاك السلامة البدنية لسجين، يعرض نفسه لعقوبة بالسجن مدة حدها اﻷدنى خمس سنوات.
