The shipper, on delivery of the goods to the carrier or to the performing party for carriage, is entitled to obtain from the carrier, at the shipper's option:
يحق للشاحن عند تسليم البضاعة إلى الناقل أو إلى الطرف المنفّذ بغرض نقلها أن يحصل من الناقل وحسب اختيار الشاحن على:

يُقر المرسل إليه، بناء على طلب الناقل أو الطرف المنفّذ الذي يسلّم البضاعة، بتسلّم البضاعة من الناقل أو الطرف المنفّذ على النحو المتعارف عليه في مكان التسليم.

" (ii) any person that is retained, either directly or indirectly, by a shipper, by a documentary shipper, by the consignor, by the controlling party or by the consignee instead of by the carrier.
" `2` أي شخص يستعين به الشاحن أو الشاحن المستندي أو المرسِل أو الطرف المسيطر أو المرسل إليه، بصورة مباشرة أو غير مباشرة، بدلا من الناقل.

A State may require the transporter which brought the alien into the State's territory to remove the alien, or may so oblige any other transporter.
ويجوز للدولة أن تطلب من الناقل الذي جلب الأجنبي إلى أراضي الدولة أن ينقله()، أو أن تجبر أي ناقل آخر على أن يفعل ذلك().

Article 6 on specific exclusions: It is not understood why chartered vessels, particularly those chartered from the carrier itself, are excluded from the application of this convention.
18- المادة 6 - استثناءات خاصة: ليس مفهوما لماذا استثنيت السفن المستأجرة من نطاق تطبيق هذه الاتفاقية، خاصة إذا كانت مستأجرة من الناقل نفسه.

There is no justification for excluding chartered ships from the application of this convention, especially if they have been chartered from the carrier itself.

The request from the carrier to the registry operator constitutes the authorization to issue an electronic bill of lading.
31- ويشكِّل الطلب المقدم من الناقل إلى مشغِّل السجل التفويض بإصدار سند الشحن الإلكتروني.

It was suggested that, for example, consistent with international sales law, if the consignee sampled the goods it would have exercised rights under the contract of carriage, and would have the obligation to accept delivery from the carrier.
وقيل إنه، مثلا، وفقا لقانون البيع الدولي، إذا أخذ المرسل إليه عيّنة من البضاعة فإنه سيكون قد مارس حقوقه بموجب عقد النقل، وسيكون عليه الالتزام بقبول تسلُّم البضاعة من الناقل.

(b) An electronic record shall be authenticated by the electronic signature of the carrier or a person having authority from the carrier.
(ب) يوثَّق السجل الالكتروني بالتوقيع الالكتروني للناقل أو لشخص مأذون له من الناقل.

If pursuant to article 2.1 the carrier and the shipper have agreed to the use of an electronic record, the shipper is entitled to obtain from the carrier a negotiable electronic record unless they have agreed not to use a negotiable electronic record or it is the custom, usage or practice in the trade not to use one.
واذا كان الناقل والشاحن قد اتفقا، عملا بالمادة 2-1، على استخدام سجل الكتروني، كان من حق الشاحن أن يحصل من الناقل على سجل الكتروني قابل للتداول، الا اذا كانا قد اتفقا على عدم استخدام سجل الكتروني قابل للتداول أو كانت العادة أو العرف أو الممارسة المتبعة في المهنة تقضي بعدم استخدام سجل من هذا القبيل.

(i) Without prejudice to the provisions of article 10.1 the holder of a negotiable transport document is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location mentioned in article 4.1.3 to such holder upon surrender of the negotiable transport document.
`1` دون مساس بأحكام المادة 10-1، يحق لحائز مستند النقل القابل للتداول أن يطالب بتسلم البضاعة من الناقل بعد وصولها إلى مكان المقصد، ويقوم الناقل عندئذ بتسليم البضاعة إلى ذلك الحائز، في الوقت والمكان المذكورين فـي المـادة 4-1-3، مقابل تسليم مستند النقل القابل للتداول.

(b) If the holder does not claim delivery of the goods from the carrier after their arrival at the place of destination, the carrier shall advise accordingly the controlling party or, if, after reasonable effort, it is unable to identify or find the controlling party, the shipper.
(ب) إذا لم يطالب الحائز بتسلم البضاعة من الناقل بعد وصولها إلى مكان المقصد، يقوم الناقل بإبلاغ الطرف المسيطر بذلك، أو بإبلاغ الشاحن إذا لم يتمكن بعد بذل جهد معقول من التعرف على الطرف المسيطر أو العثور عليه.

(a) The holder of the negotiable transport document or negotiable electronic transport record is entitled to claim delivery of the goods from the carrier after they have arrived at the place of destination, in which event the carrier shall deliver the goods at the time and location referred to in article 43 to the holder:
(أ) يحق لحائز مستند النقل القابل للتداول أو سجل النقل الإلكتروني القابل للتداول أن يطالب بتسلم البضائع من الناقل بعد وصولها إلى مكان المقصد، ويسلم الناقل البضائع إلى الحائز في هذه الحالة في الوقت والمكان المشار إليهما في المادة ٤3:

It was further indicated that the draft provision left a number of issues open, such as, for instance, the definition of " first action " , and the interplay between the removal of actions and actions by the carrier for declarations of non-liability and counter-claims.

A State may (1) forcibly escort the alien to the relevant vessel or hold the alien there; or (2) require the transporter to detain an alien already present on the vessel.

That must include doing whatever a carrier can to ensure the sealing of all loaded containers and may require that the carrier work or negotiate with shippers, forwarders or others to arrange for that sealing.
