The present note provides an overview of relevant provisions of the Firearms Protocol and proposes questions for possible discussion by the Conference.

Article 5 of the Firearms Protocol requires States to criminalize three categories of offences, namely:

The broad range of provisions in the Model Law cover both the preventive firearms control measures and the penal and procedural measures derived from the Firearms Protocol and the Organized Crime Convention.
وتشمل المجموعة الواسعة من الأحكام الواردة في القانون النموذجي كلاًّ من التدابير الوقائية لمراقبة الأسلحة النارية، والتدابير الجزائية والإجرائية المستقاة من بروتوكول الأسلحة النارية واتفاقية مكافحة الجريمة المنظَّمة.

Pursuant to Conference decision 4/2, UNODC expanded its online directory of competent national authorities to include authorities designated by States in accordance with article 12, paragraph 2, of the Firearms Protocol.
43- وعملا بمقرر المؤتمر 4/2، وسع المكتب دليله الإلكتروني للسلطات الوطنية المختصة ليشمل السلطات التي عينتها الدول وفقا للفقرة 2 من المادة 12 من بروتوكول الأسلحة النارية.

Article 10 of the Firearms Protocol contains the basic requirements of States to establish effective systems of control of the import, export and transit of firearms, their parts and components and ammunition, across national boundaries.
49- تتضمن المادة 10 من بروتوكول الأسلحة النارية المقتضيات الأساسية التي تلزم الدول بإنشاء نظم فعالة لمراقبة استيراد الأسلحة النارية وأجزائها ومكوناتها والذخيرة وتصديرها ومرورها عبر حدودها الوطنية.

Article 12 of the Firearms Protocol recognizes the fact that States possess a considerable amount of information on the illicit manufacturing and trafficking of firearms and that increased sharing of that information would greatly enhance their capacity to deal with this problem.
68- وتسلم المادة 12 من بروتوكول الأسلحة النارية بأنَّ الدول تمتلك قدرا كبيرا من المعلومات عن صنع الأسلحة النارية والاتجار بها بصورة غير مشروعة وبأنَّ تبادل تلك المعلومات سيعزّز إلى حد كبير قدرتها على التصدي لهذه المشكلة.

States parties may wish to share experiences in the implementation of the system of import and export licenses and authorizations and transit permits established under article 10 of the Firearms Protocol.
83- لعل الدول الأطراف تودُّ أن تتشارك في الخبرات المكتسبة في تنفيذ نظم رخص وأذون الاستيراد والتصدير وتصاريح العبور المنشأة بموجب المادة 10 من بروتوكول الأسلحة النارية.

The final consolidated report on the implementation of the Firearms Protocol (CTOC/COP/2006/8/Rev.1) accordingly reflects information provided by States on national implementation of the relevant provisions of the Firearms Protocol.
ومن ثم، فإن التقرير النهائي المدمج عن تنفيذ بروتوكول الأسلحة النارية (CTOC/COP/2006/8/Rev.1) يجسد المعلومات التي قدمتها الدول عن التنفيذ الوطني للأحكام ذات الصلة من بروتوكول الأسلحة النارية.

Article 5 of the Firearms Protocol establishes six offences relating to the illicit manufacturing of and trafficking in firearms, their parts and components and ammunition, with a view to ensuring that States parties establish a legal framework within which legitimate manufacturing and transfer of firearms can be conducted and which will allow illicit transactions to be identified to facilitate the prosecution and punishment of offenders.
33- تنص المادة 5 من بروتوكول الأسلحة النارية على ست جرائم تتعلق بصنع الأسلحة النارية وأجزائها ومكوناتها والذخيرة والاتجار غير المشروع بها، لضمان أن تضع الدول الأطراف إطارا قانونيا ينظم صنع الأسلحة النارية ونقلها بصورة مشروعة ويسمح بالتعرف على الصفقات غير المشروعة لتسهيل ملاحقة الجناة ومعاقبتهم.

Article 6 of the Firearms Protocol introduces the confiscation, seizure and destruction of illicitly manufactured or trafficked firearms, their parts or components and ammunition, unless some other form of disposal has been authorized, as prevention measures.
53- تنص المادة 6 من بروتوكول الأسلحة النارية على مصادرة الأسلحة النارية وأجزائها ومكوناتها والذخيرة التي جرى صنعها أو الاتجار بها بصورة غير مشروعة وعلى ضبطها وتدميرها، ما لم يكن قد صدر إذن بالتصرف فيها بشكل آخر كتدبير وقائي.

Pursuant to decision 4/2, the directory will also include authorities designated under article 13 of the Firearms Protocol as the national body or single point of contact to act as liaison on matters related to the Protocol.
وعملا بالمقرَّر 4/2، سيشمل الدليل أيضا السلطات المعيّنة بمقتضى المادة 13 من بروتوكول الأسلحة النارية باعتبارها الهيئة الوطنية أو جهة الاتصال الوحيدة للعمل بمثابة صلة وصل بشأن المسائل المتصلة بالبروتوكول.

Pursuant to decision 4/2, the directory will also include authorities designated under article 13 of the Firearms Protocol, which requests each State party to identify a national body or a single point of contact to act as liaison with other parties on matters related to the Protocol.
وعملا بالمقرّر 4/2، سيشمل الدليل أيضا السلطات المعيّنة بموجب المادة 13 من بروتوكول الأسلحة النارية التي تطلب من كل دولة طرف أن تحدِّد هيئة وطنية أو جهة اتصال وحيدة لتعمل بمثابة صلة وصل بالأطراف الأخرى في المسائل المتصلة بالبروتوكول.

The Model Law's broad range of provisions covers both the preventive firearms control measures such as manufacturing, record-keeping, deactivation, international transfers of firearms and related brokering activities, and the penal and procedural measures derived from the Firearms Protocol and the Transnational Organized Crime Convention.
وتغطي الطائفة العريضة من الأحكام الواردة في القانون النموذجي التدابير الوقائية لمراقبة الأسلحة النارية، مثل صنع الأسلحة النارية وحفظ سجلاتها وتعطيل الأسلحة النارية ونقلها دوليا وأنشطة السمسرة ذات الصلة، والأحكام الجزائية والإجرائية المستقاة من بروتوكول الأسلحة النارية واتفاقية الجريمة المنظَّمة.

The model law is a voluntary technical assistance tool containing preventive measures on manufacturing, record-keeping, deactivation, international transfers of firearms and related brokering activities, as well as penal and procedural provisions derived from the Firearms Protocol and the Organized Crime Convention.
18- والقانون النموذجي أداة مساعدة تقنية طوعية تتضمن تدابير وقائية بشأن صنع الأسلحة النارية والاحتفاظ بسجلاتها وإبطال مفعولها ونقلها دوليا وأنشطة السمسرة ذات الصلة، إضافة إلى أحكام جزائية وإجرائية مشتقة من بروتوكول الأسلحة النارية واتفاقية الجريمة المنظمة.
