In October 2013, during its second universal periodic review, China had announced that it was reducing the application of the death penalty by taking a series of important measures, including reducing the number of capital crimes, strengthening the role of defence lawyers, ensuring that suspects in capital cases were represented by a lawyer, and excluding the use of confessions extracted through torture.
وفي أكتوبر عام 2013، أعلنت الصين أثناء الاستعراض الدوري الشامل الثاني المتعلق بها أنها تعمل على الحد من تطبيق عقوبة الإعدام عن طريق اتخاذ سلسلة من التدابير الهامة، بما في ذلك خفض عدد الجرائم التي يعاقب عليها بالإعدام، وتعزيز دور محامي الدفاع، وضمان توفير محامين للدفاع عن المشتبه بهم في القضايا التي يعاقب عليها بالإعدام، واستبعاد استخدام الاعترافات المنتزعة عن طريق التعذيب.

Forty delegates from 10 States in the Middle East and North Africa participated in the workshop and adopted a set of principles and recommendations to reduce the application of the death penalty in both legislation and practice and in regard to the role of legal professionals, such as judges, public prosecutors and lawyers, in this area.
وشارك في حلقة العمل 40 مندوبا من 10 دول في الشرق الأوسط وشمال أفريقيا واعتمدوا مجموعة من المبادئ والتوصيات للحد من تطبيق عقوبة الإعدام في التشريعات والممارسة على حد سواء وفيما يتعلق بدور المشتغلين بالقانون، مثل القضاة وأعضاء النيابة العامة والمحامين في هذا المجال().

With regard to the death penalty, the Special Rapporteur pointed out that article 6 of the International Covenant on Civil and Political Rights enjoined State Parties to limit the application of the death penalty to the most serious crimes, and that the Human Rights Committee in one of its General Comments had pointed out that although article 6 did not prohibit the death sentence it certainly pointed in the direction of eventual abolition.
وفيما يتعلق بعقوبة الإعدام، أوضح المقرر الخاص أن المادة 6 من العهد الدولي الخاص بالحقوق المدنية والسياسية تقتضي قيام الدول الأطراف بالحد من تطبيق عقوبة الإعدام بحيث تقتصر على الجرائم الأشد خطورة، وأن اللجنة المعنية بحقوق الإنسان قد أوضحت في تعليق من تعليقاتها العامة أنه بالرغم من أن المادة 6 لا تحظر عقوبة الإعدام، فإنها تشير بالتأكيد إلى إلغاء هذه العقوبة في النهاية.

36. In his report on individual communications (A/HRC/14/24/Add.1), the Special Rapporteur expressed his concern at the use of the death penalty in relation to non-serious crimes, transparency in executions and the death penalty for juveniles.
36- وفي تقريره عن البلاغات الفردية (A/HRC/14/24/Add.1) أعرب المقرر الخاص عن قلقه من تطبيق عقوبة الإعدام على جرائم غير خطيرة، وقلقه إزاء الشفافية في عمليات تنفيذ الحكم وفرض عقوبة الإعدام على الأحداث.

98. The Special Rapporteur further calls upon Governments to review their existing legislation and legal practice with the aim of limiting the use of the death penalty to exclude crimes that cannot be considered " most serious " , as provided in article 6 of the International Covenant on Civil and Political Rights.
98- وتدعو المقررة الخاصة كذلك الحكومات إلى استعراض تشريعاتها وممارساتها القانونية القائمة استعراضاً يرمي إلى الحد من تطبيق عقوبة الإعدام واستبعاد الجرائم التي لا يمكن اعتبارها " من أشد الجرائم خطورة " ، وفقا لنص المادة 6 من العهد الدولي الخاص بالحقوق المدنية والسياسية.

While state governments retain primary responsibility for establishing procedures and policies that govern state capital prosecutions, the Supreme Court has excluded from application of the death penalty those offenders who, at the time of the offense, were under age 18 or had intellectual disabilities.
وبينما تتحمل حكومات الولايات المسؤولية الأساسية عن وضع الإجراءات والسياسات التي تنظم محاكمات الولاية التي تنتهي بعقوبة الإعدام، فإن المحكمة العليا استبعدت من تطبيق عقوبة الإعدام جميع المجرمين الذين كانوا دون سن الثامنة عشرة أو كانوا معاقين ذهنياً وقت ارتكاب الجريمة(4).
