The State party should broaden the scope of the definition of rape in article 177 of the Criminal Code and ensure that incest, sexual abuse other than actual sexual intercourse, as well as rape of men, are considered serious criminal offences; remove the burden on victims to prove resistance against the assault; and prosecute rape and other crimes of sexual violence ex officio.
ينبغي أن توسع الدولة الطرف نطاق تعريفها للاغتصاب في المادة 177 من القانون الجنائي وأن تسهر على اعتبار سفاح المحارم والاعتداء الجنسي خلاف ممارسة الجنس العادية، وكذلك اغتصاب الذكور، جرائم جنائية خطيرة؛ وتخليص الضحايا من عبء سوْق الأدلة على مقاومة الاعتداء، ومحاكمة مرتكبي الاغتصاب وغيره من جرائم العنف الجنسي.

(f) Expressing deep concern regarding the continued incidents of rape and other forms of sexual violence against children, including those perpetrated by members of the armed forces, and strongly encouraging the Government to systematically investigate and prosecute all perpetrators of rape and other crimes of sexual violence, and to strengthen prevention and response strategies;
(و) ويعرب عن عميق قلقه إزاء استمرار حوادث الاغتصاب وغيره من أشكال العنف الجنسي ضد الأطفال، بما في ذلك الحوادث التي يرتكبها أفراد من القوات المسلحة، ويشجع الحكومة بشدة على القيام، بانتظام، بالتحقيق في جرائم الاغتصاب وغيرها من جرائم العنف الجنسي ومقاضاة جميع مرتكبيها، وتعزيز استراتيجيات منع هذه الجرائم والتصدي لها؛

In line with the Committee's previous recommendations (see CCPR/C/JPN/CO/5, paras. 14 and 15) the State party should take concrete action to prosecute rape and other crimes of sexual violence ex officio, raise without further delay the age of consent for sexual activities and review the elements of the crime of rape, as established in the Third Basic Plan for Gender Equality.
تمشياً مع التوصيات السابقة للجنة (انظر CCPR/C/JPN/CO/5، الفقرتان 14 و15) ينبغي أن تتخذ الدولة الطرف إجراءات ملموسة لملاحقة المتورطين في الاغتصاب وغيره من جرائم العنف الجنسي بحكم صفتها، والقيام دون تأخير برفع سن الموافقة على إقامة علاقات جنسية، ومراجعة عناصر جريمة الاغتصاب كما هي محددة في الخطة الأساسية الثالثة للمساواة بين الجنسين.

For this reason, the United Nations, when mediating or facilitating peace processes, does not recognize amnesty for genocide, crimes against humanity, war crimes and other serious violations of human rights and international humanitarian law, including rape and other sexual violence crimes.
ولهذا السبب فإن الأمم المتحدة، عند اضطلاعها بأعمال الوساطة أو التيسير في عمليات السلام، لا تقر العفو عن الإبادة الجماعية أو الجرائم المرتكبة ضد الإنسانية أو جرائم الحرب أو غير ذلك من الانتهاكات الجسيمة لحقوق الإنسان والقانون الإنساني الدولي، بما في ذلك الاغتصاب وغيره من جرائم العنف الجنسي.
