The Committee considers that, although it is in principle for the domestic courts of the State party to evaluate facts and evidence in a particular case, it is for the Committee to examine whether or not the facts as established by the Court constitute a violation of the Covenant.
وترى اللجنة أنه وإن كان متروكا للمحاكم المحلية للدولة الطرف، من حيث المبدأ، أن تقيِّم الوقائع والأدلة المعروضة في قضية معينة، فإن من شأن اللجنة أن تبحث ما إذا كانت الوقائع كما قررتها المحكمة تشكل انتهاكا للعهد أم لا.

وتذكّر اللجنة بأنه من شأن محاكم الاستئناف بالدول الأطراف في العهد بوجه عام وليس من شأن اللجنة أن تقيّم الوقائع والأدلة في قضية معينة، إلا إذا أمكن التأكد من أن تقييم الأدلة هو والتعليمات الصادرة إلى هيئة المحلفين كانا تعسفيين بوضوح أو كانا على نحو آخر بمثابة إنكار للعدالة(5).
