Pursuant to article 10 of the Public Health Act of 26 June 1997, aliens are entitled to health care in accordance with the rules provided for in international agreements to which Azerbaijan is a party.
36- عملاً بالمادة 10 من قانون الصحة العامة الصادر في 26 حزيران/يونيه 1997، يحق للأجانب الحصول على الرعاية الصحية وفقاً للقواعد المنصوص عليها في الاتفاقيات الدولية التي تكون أذربيجان طرفاً فيها.

The relevant part of the Public Health Act was based on the premise that sterilization was reversible, whereas the WHO guidelines emphasized that the counselling prior to the intervention should cover its irreversibility.
ويرتكز الجزء ذو الصلة من قانون الصحة العامة على قابلية التعقيم لأن يُعكَس، بينما تؤكد المبادئ التوجيهية لمنظمة الصحة العالمية أن النصح الذي يجري تقديمه قبل هذه العملية ينبغي أن يغطي عدم إمكانية عكسها.

24. Section 1 of Part I of the Public Health Act No. 89 of 1981 stipulates that: “The aim of mother and child care and endeavours to promote family health is to fulfil the duty of society and the State towards mothers and children from the time when the latter are formed as a foetus.
٤٢- كذلك أشار الفرع اﻷول من الفصل اﻷول من قانون الصحة العامة رقم ٩٨ لسنة ١٨٩١ إلى " أن رعاية اﻷمومة والطفولة وصحة اﻷسرة تهدف إلى تحقيق واجب المجتمع والدولة تجاه اﻷم والطفل منذ تكوينه جنينا.

137. An optional remedy procedure, provided for in article L.3211-12 of the Public Health Code, makes it possible to petition at any time the liberties and detention judge, within whose district the receiving psychiatric establishment is located, to order the immediate termination of the psychiatric care imposed.
137- وتمكن الدعوى الاختيارية المنصوص عليها في المادة L. 3211-12 من قانون الصحة العامة من اللجوء في أي وقت إلى قاضي الحريات والاحتجاز الذي تقع مؤسسة الأمراض النفسية التي يوجد فيها المريض ضمن نطاق اختصاصه لكي يأمر بالإنهاء الفوري لتدبير الرعاية النفسية.

That would have been the result of immediate application of the provisions of article 131-4 of the new Code, which establishes a maximum of 10 years' ordinary imprisonment, whereas article L 627 of the Public Health Code provided for up to 20 years' imprisonment.
وكان هذا الحل سينجم عن التطبيق الفوري لأحكام المادة 131-4 من القانون الجديد الذي يفرض عقوبة بالسجن مع الأشغال الشاقة لمدة أقصاها عشر سنوات، في حين كانت المادة L627 من قانون الصحة العامة تنص على عقوبات قد تصل إلى 20 سنة من السجن.

176. By Article 9 of the Public Health Law: " the State provides every citizen with the benefits of complete free medical service.
176 - تنص المادة 9 من قانون الصحة العامة على ما يلي: ' ' توفر الدولة لكل مواطن مزايا الخدمات الطبية المجانية الكاملة.

(c) That article 30 of the General Health Act and section 326 of the Code of Criminal Procedure violate the privacy and reproductive health rights of women and result in the prosecution of women for accessing emergency obstetric care;
ج - تنتهك المادة 30 من قانون الصحة العامة والمادة 326 من قانون الإجراءات الجنائية خصوصية المرأة وحقوقها الصحية الإنجابية وتؤدي إلى محاكمة المرأة لحصولها على رعاية توليد عاجلة؛

17. Under article 66 of the Public Health Act of 2008, every contravention of the Act or regulations made thereunder in matters relating to the organization of public health or maternal and child health is an offence.
17- وتعاقب المادة 66 من قانون الصحة العامة لسنة 2008 على مخالفة القانون أو الأنظمة الصادرة بموجبه فيما يتعلق بتنظيم أمور الصحة العامة والأمومة والطفولة.

Medical sterilization performed illegally is punishable by law (article 33 of the Public Health Act).
ويعاقب القانون على إجراء عمليات التعقيم الطبية بصورة غير مشروعة (المادة 33 من قانون الصحة العامة).

The child's father, legal guardian or custodian is responsible for taking care of his health, as affirmed in article 44, paragraph 1, of the Public Health Act of 1975, pursuant to which the child's father, guardian, custodian, school principal or health officer is responsible for ensuring that the child receives all initial and subsequent inoculations.
فكل من والد الطفل أو ولي أمره أو من يقوم بكفالته يكون مسؤولا عن الاهتمام بصحته. ويؤكد ذلك ما جاء في المادة 44(1) من قانون الصحة العامة لسنة 1975 على مسؤولية والد الطفل أو ولي أمره أو من يقوم بكفالته أو مدير المدرسة أو المسؤول عن الصحة من تقديمه للتطعيم وإعادة التطعيم.

In accordance with articles 17 and 23 of the Public Health Act of 26 June 1997, every woman has the right during pregnancy, childbirth and the post-partum period to free medical care at specialist medical institutions in the health-care system.
226- وفقاً للمادتين 17 و23 من قانون الصحة العامة الصادر في 26 حزيران/يونيه 1997، يحق لكل امرأة أن تحصل، أثناء الحمل وعند الولادة وخلال فترة ما بعد الولادة، على الرعاية الطبية المجانية في المؤسسات الطبية المتخصصة التابعة لنظام الرعاية الصحية.

It was the position of the Government that its laws were in conformity with both WHO and Oviedo standards, but the Committee was of the view that section 187.7 of the Public Health Act was still not in line with international standards, since it provided that a special information procedure was not required when sterilization was done for health reasons, in the judgment of the doctor.
وموقف الحكومة أن قوانينها تتفق مع معايير كل من منظمة الصحة العالمية واتفاقية أوفييدو، إلا أن اللجنة ترى أن القسم 187-7 من قانون الصحة العامة ما زال لا يتماشى مع المعايير الدولية حيث أنه ينص على عدم وجوب إجراء الإبلاغ الخاص عندما يقرر الطبيب القيام بالتعقيم لأسباب صحية.

82. The provisions of article 4 (1) (a) of the Public Health Act of 1975 provide for the participation of people's local government councils in elaborating the general principles and standards governing the health of the environment as the enduring basis for a safe and healthy life.
٢٨- نصت أحكام المادة ٤)١()أ( من قانون الصحة العامة لسنة ٥٧٩١ على مشاركة مجالس الحكم الشعبي المحلي في وضع اﻷسس العامة والمستويات التي تحكم صحة البيئة باعتبارها اﻷساس القويم لحياة معافاة سليمة. الفقرة ٨ من المبادئ التوجيهية

In this context, it should be noted that, under article 64 of the Public Health Act, the Minister or a secretary general, director, physician and any official delegated by the Minister shall have, each within his particular sphere of competence, the capacity of a law enforcement officer and may undertake the related tasks and duties.
وتجدر الإشارة في هذا السياق إلى أنه وبموجب نص المادة (64) من قانون الصحة العامة يكون للوزير والأمين العام والمدير والطبيب وأي موظف يفوضه الوزير كلٌ ضمن اختصاصه صفة الضابطة العدلية للقيام بمهامها وتنفيذ واجباتها.

She told the Court that she had not been informed of her rights upon admission, in particular that under article L351 of the Public Health Code she could have appealed directly to the President of the Court of Major Jurisdiction who, after listening to both sides of the argument and making any necessary enquiries, could have ordered her immediate release.
وذكرت للمحكمة جملة أمور منها أنها لم تُعلَم بحقوقها أثناء إدخالها المستشفى، وبخاصة أنه كان بإمكانها الطعن مباشرة بموجب المادة لام -351 من قانون الصحة العامة أمام رئيس المحكمة العليا الذي كان سيصدر بعد سماع أقوال الجانبين حكماً حضورياً مستعجلاً يقضي بخروجها على الفور.

In the author's view, the reason it had not been possible for her to obtain these documents was that the hospital had failed to transmit the administrative notifications stipulated by law to the representative of the State and to the psychiatric hospitalization committee of the department in question, in accordance with article L334 of the Public Health Code.
وترى صاحبة البلاغ أنه لا تفسير لاستحالة حصولها على مثل هذه الوثائق إلا عدم قيام المستشفى بتقديم الإخطارات الإدارية المنصوص عليها في القانون إلى ممثل الدولة وإلى اللجنة الإدارية المكلفة بالإيداع في مستشفيات الطب النفسي، عملاً بالمادة لام -334 من قانون الصحة العامة.

3.2 The author submits that she was deprived of her right to challenge her detention during the period of committal by means of the remedy provided for under article L351 of the Public Health Code, allowing her to appeal directly to the President of the Court of Major Jurisdiction for immediate release.
3-2 وفيما يتعلق بالاعتراض على الاحتجاز أثناء فترة الإيداع في المستشفى، تزعم صاحبة البلاغ أنها حرمت من حقها في سبيل الانتصاف الذي تنص عليه المادة لام -351 من قانون الصحة العامة والذي كان من شأنه أن يتيح لها أن تلجأ مباشرة إلى رئيس محكمة المقاطعة للبت بصفة مستعجلة في طلب إخراجها على الفور.

135. Under article L.3211-3 of the Public Health Code, the above rights, except items (5), (7) and (8), may be exercised, upon request, by relatives or any persons acting on behalf of the patient.

177. Under article 3 and articles 18-28 of the Public Health Law, the State gives priority to the prophylactic line in public health.

Under article 9 of the Public Health Law: " The State provides every citizen with the benefits of complete free medical service.

However, in view of the entry into force of the Convention, steps are being taken to revise existing legislation; there is already a proposal to amend articles 10 and 18 of the General Health Act No. 14/1986 to include a mention of disability as one of the grounds on which no person may be discriminated against.

The first kind is governed by the Public Health Code, articles L3213-1 ff., and covers those whose state of mental health represents a danger to others or a serious breach of law and order.
