3. Article 7, paragraph 5, of the draft rules provides for the possibility for the respondent State to refuse access to information if the disclosure of that information would be contrary to its essential security interests.

One outcome was the decision taken to split article 4 of the draft rules into two parts dealing with claimants and respondents separately and to consider the article anew at the Working Group's next session.

1. We would suggest that the Permanent Court of Arbitration (PCA) in the Hague mentioned as a special example be deleted from paragraph 1, article 6 of the draft rules.

The end of article 34, paragraph 2, of the draft rules contains appropriate wording in square brackets concerning these two issues, for which provision must be made.
وتتضمّن نهاية الفقرة 2 من المادة 34 من مشروع القواعد صياغةً مناسبةً وردت بين قوسين معقوفتين بشأن هاتين المسألتين ويجب أخذها بعين الاعتبار.

" 4. Article 23 of the draft rules provides that, upon conclusion of the proceedings, the chairman of the commission shall deliver the documents in possession of the secretariat of the commission to the Secretary-General of the United Nations, who shall preserve their secrecy.

" 5. Finally, article 28, paragraph 3, of the draft rules provides that the terms of settlement accepted by the parties are subject to the registration obligation laid down in Article 102 of the Charter.

3. Paragraph 3, article 23 of the draft rules states that an arbitration court shall continue to arbitrate and make awards while a court of law is still hearing the objection to the competence of the arbitration court.

The Protection from Domestic Violence (Amendment) Act 2007 has not yet been proclaimed pending the finalization of the draft rules which have been prepared by the Rules Committee.

9. ٩ - وإلى جانب هذه العناصر اﻷساسية، يمكن لقرار مؤتمر اﻷطراف أن يحيط علما بتوقيت دفع المساهمات السنوية من جانب اﻷطراف وفقا للفقرة ٤١ )أ( من مشروع القواعد وأن يطلب إلى الحكومات والمنظمات، إذا اقتضى اﻷمر، تقديم مساهمات إضافية لمواجهة مصروفات الميزانية.
