The first paragraph of this guideline provides that the fact that a treaty provision reflects a customary norm is a pertinent factor in assessing the validity of a reservation.

Paragraphs 1.16 to 1.20 of this guideline apply when this distinction is made.

Paragraph 1 of this guideline specifies that when a treaty continues in force in respect of a unified State, objections to a reservation formulated one of the uniting States which, at the date of the succession of States, was a contracting State in respect of which the treaty was not in force shall not be maintained.
وهكذا فإن الفقرة 1 من هذا المبدأ التوجيهي توضح أنه عندما يستمر نفاذ المعاهدة إزاء الدول المتحدة، فإن الاعتراضات على التحفظات التي صاغتها دولة من الدول المندرجة في الاتحاد كانت، في تاريخ خلافة الدول، دولة متعاقدة لم تكن المعاهدة نافذة إزاءها لا تعود قائمة.

Paragraph 1 of this guideline specifies that when a treaty continues in force in respect of a unified State, objections to a reservation formulated one of the uniting States which, at the date of the succession of States, was a contracting State in respect of which the treaty was not in force shall not be maintained.

(16) Paragraph 4 of guideline 5.1.2 recalls that any reservation formulated by a successor State formed from a uniting or separation of States, in accordance with paragraph 3 of this guideline, is subject to the conditions of permissibility set out in subparagraphs (a), (b) and (c) of guideline 3.1, which reproduces article 19 of the 1969 and 1986 Vienna Conventions.

This right is subject to the general conditions laid down in article 19, subparagraphs (a), (b) and (c), of the 1969 Vienna Convention on the Law of Treaties and reiterated in guideline 3.1, to which paragraph 2 of this guideline refers.

(9) It should be noted that the purpose of this guideline is not to fill the gaps in the list that appears in the Vienna definition, particularly the omission of the possibility of reservations formulated when notifying territorial application of a treaty; that is the purpose of draft guideline 1.1.4.

183. As noted by the International Law Commission itself, the first paragraph of this guideline is " a reminder [...] of a fundamental principle [...] according to which the nullity of an invalid reservation depends on the reservation itself and not on the reactions it may elicit " , and " is perfectly consistent with guideline 3.1 [...], guideline 3.3.2 and guideline 4.5.1 " .

(6) While this provision establishes a general presumption in favour of the maintenance of reservations, there are nonetheless exceptions to this presumption in certain cases involving the uniting of two or more States; these are covered by guideline 5.1.3, which is referred to in paragraph 1 of the present guideline.
