In response, it was pointed out that according to the practice of the United Nations, the final clauses had to be submitted for examination to the Treaty Section of its Office of Legal Affairs, which exercised the Secretary-General's depositary functions, and that the Secretariat would ensure that the final clauses were in accordance with the depositary's practice.

The functions of the depositary in connection with an impermissible reservation should be exercised restrictively and might be limited to cases of reservations that were prohibited in the treaty itself or purely objective cases in which the impermissibility was self-evident.
