لا تُجرَى مفاوضاتٌ بين الجهة المشترية وأيِّ مورّد أو مقاول بشأن العطاء الذي قدّمه ذلك المورِّد أو المقاول.

لا تُجرَى مفاوضاتٌ بين الجهة المشترية وأيِّ مورّد أو مقاول بشأن العطاء الذي قدّمه ذلك المورّد أو المقاول.

The cancellation of the auction shall be communicated promptly to each registered supplier or contractor.
ويُسارَع إلى إبلاغ كل مورّد أو مقاول مسجّل بإلغاء المناقصة.

It was further explained that in the case of opened submissions, the notice of cancellation should also be given individually to each supplier or contractor that had presented a submission.
وأُوضح كذلك أنه في حال العروض المفتوحة فينبغي، أيضاً توجيه إشعار الإلغاء فرديا إلى كل مورّد أو مقاول قدم عرضا.

The procuring entity shall provide the solicitation documents to each supplier or contractor that responds to the invitation to tender in accordance with the procedures and requirements specified therein.
توفّر الجهة المشترية وثائق الالتماس لكل مورّد أو مقاول يلبي الدعوة إلى تقديم العطاءات وفقاً للإجراءات والمتطلبات المحددة في تلك الدعوة.

If pre-qualification proceedings have been engaged in, the procuring entity shall provide a set of solicitation documents to each supplier or contractor that has been pre-qualified and that pays the price, if any, charged for those documents.
وفي حال القيام بإجراءات تأهيل أولي، توفّر الجهة المشترية مجموعة من وثائق الالتماس لكل مورّد أو مقاول يكون قد تأهَّل أوَّليًّا ويدفع الثمن المتقاضى عن تلك الوثائق، إن كان لها ثمن.

Thus in some systems, Type 2 framework agreements were concluded with one or more suppliers or contractors, and in others, they were concluded in all cases with more than one supplier or contractor;
ومن ثم، يقضي بعض النظم بأن تُبرَم الاتفاقات الإطارية من النوع 2 مع واحد أو أكثر من المورّدين أو المقاولين، بينما تقضي نظم أخرى بأن تُبرم تلك الاتفاقات في جميع الحالات مع أكثر من مورّد أو مقاول واحد؛

If, however, the procurement were cancelled during subsequent stages of the procurement proceedings, grounds should be provided in the notice of cancellation issued individually to each supplier or contractor concerned.
أما إذا حدث إلغاء الاشتراء أثناء المراحل اللاحقة من إجراءات الاشتراء فينبغي بيان الأسباب في إشعار الإلغاء الذي يوجُّه فرديا إلى كل مورّد أو مقاول معني.

The importance of sending a notice individually to each supplier or contractor concerned was highlighted.
231- وشدّد على أهمية إرسال إشعار إلى كل مورّد أو مقاول معني.

34. It was explained that the proposals were not intended to affect the right of the procuring entity to reject a tender under other articles of the Model Law or disqualify a supplier or contractor under articles 6 and 7 of the Model Law.
34- وأُوضح أنه لا يقصد من الاقتراحين المساس بحق الجهة المشترية في رفض العطاء بمقتضى مواد أخرى من القانون النموذجي أو إسقاط أهلية مورّد أو مقاول بمقتضى المادتين 6 و7 من القانون النموذجي.

It was suggested that the Guide in this respect should draw a distinction between negotiations that had to be held with all suppliers or contractors before the award of the procurement contract, and consecutive negotiations, in which the procurement contract could be awarded upon completion of the dialogue with any supplier or contractor.
واقترح أن يميز الدليل، في هذا الصدد، بين المفاوضات التي يجب أن تُجرى مع كل الموردين أو المقاولين قبل إرساء عقد الاشتراء، والمفاوضات التعاقبية التي يمكن أن يُرسى فيها عقد الاشتراء عند الانتهاء من التحاور مع أي مورّد أو مقاول.

It also agreed to add the words " duly notified of the proceedings " after the words " a supplier or contractor " at the beginning of the second sentence of paragraph 1.
واتّفقت أيضا على إضافة العبارة " يُخطر على النحو الواجب بالإجراءات " بعد العبارة " أي مورّد أو مقاول " في بداية الجملة الثانية من الفقرة 1.

4. Where the procuring entity engages in single-source procurement in accordance with paragraph 5 of article 30 of this Law, it shall solicit a proposal or price quotation from a single supplier or contractor.
4- عندما تقوم الجهة المشترية بالاشتراء من مصدر واحد وفقاً للفقرة 5 من المادة 30 من هذا القانون، تلتمس اقتراحاً أو عروض أسعار من مورّد أو مقاول واحد.

General principles of transparency and fair and equitable treatment indicate that each supplier or contractor should be subject to the same terms and conditions; the provisions therefore limit exceptions to minor variations that concern only those provisions that justify the conclusion of separate agreements; those justifications are to be put on the record.
وتقتضي المبادئ العامة للشفافية والمعاملة المنصفة والعادلة أن يكون كل مورّد أو مقاول خاضعا لنفس الأحكام والشروط؛ وبناء عليه، تقصر الأحكام الاستثناءات على التغييرات الثانوية الأهمية التي لا تتعلّق إلاّ بالأحكام التي تبرر إبرام اتفاقات منفصلة؛ ولا بد من تسجيل هذه المبررات.

4. Paragraph (2) records that a procurement contract can be awarded only to a supplier or contractor that is a party to the framework agreement.
4- وتسجّل الفقرة (2) أنه لا يمكن إرساء أيِّ عقد اشتراء إلاّ على مورّد أو مقاول طرف في الاتفاق الإطاري.

(c) " Type 3 " framework agreements, concluded with more than one supplier or contractor, with competition at the second stage, and with terms and conditions and specifications (and, in some systems, evaluation criteria) established in advance.
(ج) الاتفاقات الإطارية من " النوع 3 " ، التي تُبرم مع أكثر من مورّد أو مقاول واحد، مع وجود تنافس في المرحلة الثانية، ومع تحديد مسبق للأحكام والشروط والمواصفات (وكذلك لمعايير التقييم في بعض النظم).

(6) A closed framework agreement is an agreement to which any supplier or contractor who is not initially a party to the framework agreement may not subsequently become a party.
(6) الاتفاق الإطاري المغلق هو اتفاق لا يجوز لأي مورّد أو مقاول لم يكن طرفا فيه في بادئ الأمر أن يصبح طرفا فيه في وقت لاحق.

(f) If the procuring entity intends to enter into a framework agreement with more than one supplier or contractor, a statement that the suppliers or contractors that are parties to the framework agreement will be ranked according to the selection criteria specified;
(و) بياناً بأن المورّدين أو المقاولين الأطراف في الاتفاق الإطاري سيرتَّبون وفقا لمعايير الاختيار المحددة، إذا كانت الجهة المشترية تعتزم إبرام اتفاق إطاري مع أكثر من مورّد أو مقاول واحد؛
