20. With regard to the relationship between articles 18 and 25 of the Convention, it should be noted that the two articles applied to a treaty as separate regimes before its entry into force; in other words, the obligation not to defeat the object and purpose of a treaty prior to its entry into force could be applied irrespective of its provisional application.

88. Although the obligation not to defeat the object and purpose of a treaty prior to its entry into force, established in article 18 of the Vienna Convention, and the provisional application of treaties had the same scope ratione temporis, they gave rise to different legal regimes and should be treated as such.

The first conclusion stated the obvious without fully defining the rule concerning the object and purpose of a treaty or the content and nature of the obligation which it created for States parties to a convention and for reserving States. In that regard, not only articles 19 and 20 but also article 18 of the Vienna Convention should be looked at again because the Convention offered no guidance on how to make such a determination.

A reservation would, however, be effective vis-à-vis the objecting State if it was not incompatible with the object and purpose of the treaty and was permitted or not prohibited by the treaty.

Adopted after heated debate in the Commission, draft article 20, paragraph 2 (b), adopted on first reading by the Commission in 1962, established a link between objections and the incompatibility of reservations with the object and purpose of the treaty, which seemed to be the sine qua non for validity in both cases.
