In accordance with Annex V of UNCLOS, each State party is entitled to nominate four conciliators, each of whom shall be a person enjoying the highest reputation for fairness, competence and integrity.

The reference to " two or more conciliators " was particularly welcome, since the assumption was all too often made that there should always be an odd number of conciliators.

50. The conciliation commission consists of five conciliators chosen from a list of conciliators drawn up and maintained by the Secretary-General in accordance with article 2 of annex V. As at 31 August 1996, only one State Party, the Sudan, had submitted the nominations of Dr. Abd ElRahman Elkhalifa and Sayed Eltahir Hamdalla.
٥٠ - وتتألف محكمة التوفيق من خمسة موفقين يجري اختيارهم من قائمة من الموفقين يتولى اﻷمين العام وصفها والاحتفاظ بها، وفقا للمادة ٢ من المرفق الخامس. وحتى ٣١ آب/أغسطس ١٩٩٦، كانت هناك دولة طرف واحدة فقط، قدمت مرشحين، هي السودان، وهما الدكتور عبد الله الخليفة والسيد سيد الطاهر حمد الله.

4. If, at the end of the three-month period referred to in paragraph 2 of this article, the parties have appointed three conciliators but have not been able to agree which of them shall act as president, the president shall be chosen in the manner described in that paragraph.
٤ - في نهاية مهلة الثلاثة أشهر المشار اليها في الفقرة الثانية من هذه المادة، إذا كان الطرفان قد عينا ثلاثة موفقين ولم يتمكنا من الاتفاق على من يكون رئيسا، يتم اختيار الرئيس بالطريقة المشار إليها في تلك الفقرة.

" 4. If, at the end of the three-month period referred to in paragraph 2 of this article, the parties have appointed three conciliators but have not been able to agree which of them shall act as president, the president shall be chosen in the manner described in that paragraph.
" ٤ - إذا انقضت مهلة الثلاثة أشهر المشار اليها في الفقرة الثانية من هذه المادة ويكون الطرفان قد عينا ثلاثة موفقين دون أن يتمكنا من الاتفاق على من يكون رئيسا، يختار الرئيس بالطريقة المشار اليها في تلك الفقرة.

" 3. If at the end of the three-month period referred to in the preceding paragraph, the parties have been able to appoint only one or two conciliators, the two conciliators or the conciliator still required shall be appointed in the manner described in the preceding paragraph.
" ٣ - وإذا انقضت مهلة الثلاثة أشهر المشار إليها في الفقرة السابقة ولم يتمكن الطرفان من تعيين سوى موفق واحد أو موفقين فإنهما يشرعا في تعيين الموفقين الباقيين أو الموفق الباقي على النحو المشار اليه في الفقرة السابقة.

" 4. If, at the end of the three-month period referred to in paragraph 2 of this article the parties have appointed three conciliators but have not been able to agree which of them shall act as chairman, the chairman shall be chosen in the manner described in that paragraph.
" ٤ - وإذا انقضت مهلة الثلاثة أشهر المشار إليها في الفقرة الثانية من هذه المادة ويكون الطرفان قد عينا ثلاثة موفقين لكن لم يتمكنا من الاتفاق على من يكون رئيسا فإنهما يشرعان في اختيار الرئيس بالطريقة المشار إليها في تلك الفقرة.
