Application of this safeguard in recent years has focused on two main issues: the mandatory death penalty, and the use of the death penalty for crimes that are not intentional and that do not have lethal or other extremely grave consequences.

In this regard, he wishes to bring to the Government's attention that paragraph 1 of the safeguards guaranteeing protection of the rights of those facing the death penalty, approved by the Economic and Social Council in 1984, stipulates that capital punishment may be imposed only for the most serious crimes with lethal or other extremely grave consequences.
