This time, however, the author's son asked the detention centre's authorities to keep him there, as otherwise, according to him, the police officers would kill him.
غير أن نجل صاحب البلاغ طلب هذه المرة إلى سلطات المركز إبقاءه هناك لأن موظفي الشرطة، حسبما أفاد به، قد يقتلونه لو لم يحصل ذلك.

The State party was further required to initiate criminal proceedings against the persons alleged to be responsible for those violations, and to bring the author's son forthwith before a judge to answer the charges against him or to release him.
والدولة الطرف مطالبة كذلك باتخاذ إجراءات جنائية ضد الأشخاص الذين يزعم أنهم مسؤولون عن هذه الانتهاكات، وإحضار نجل صاحب البلاغ أمام قاض للرد على التهم الموجهة إليه أو الإفراج عنه.

1.3 On 15 March 2005, the Committee received unofficial information that the author's son might have been executed in early March.
1-3 وفي 15 آذار/مارس 2005، تلقت اللجنة معلومات غير رسمية تفيد بأن من المحتمل أن يكون نجل صاحب البلاغ قد أُعدم في مطلع آذار/مارس.

In the absence of any pertinent observations from the State party in this respect, and without having to examine separately each of the author's allegations in this connection, the Committee considers that in the circumstances of the case, the facts as presented reveal a separate violation of the author's son's rights under article 14, paragraph 1, of the Covenant.
وفي غياب أي ملاحظات وجيهة من جانب الدولة الطرف في هذا الصدد، ودون الحاجة إلى النظر بشكل منفصل في كل ادعاء من ادعاءات صاحب البلاغ بهذا الخصوص، ترى اللجنة أن وقائع هذه القضية كما عُرِضت تكشف عن وقوع انتهاك منفصل لحقوق نجل صاحب البلاغ بموجب الفقرة 1 من المادة 14 من العهد.

8.4 The Committee considers that in the present case, the courts, and this was uncontested by the State party, failed to address properly the victim's complaints related to his ill-treatment by the police and did not pay due attention to the numerous requests of the author's son and his defence counsel to have a number of witnesses interrogated and other evidence examined in court in this connection.
8-4 وترى اللجنة أن المحاكم، وهذا ما لم تطعن فيه الدولة الطرف، لم تعالج في إطار هذه القضية بالشكل المطلوب شكاوى الضحية المتعلقة بإساءة معاملته على أيدي رجال الشرطة ولم تول الاهتمام الواجب لطلبات نجل صاحب البلاغ ومحاميه العديدة لاستجواب عدد من الشهود ودراسة أدلة أخرى في المحكمة بهذا الخصوص.

From the uncontested information before the Committee, it transpires that the charges and evidence against the author's son left room for considerable doubt, while their evaluation by the State party's courts was in itself in violation of fair trial guarantees of article 14, paragraph 3.
ويرشح من المعلومات المعروضة على اللجنة والتي لم تعترض عليها الدولة الطرف أن التهم والأدلة الموجهة ضد نجل صاحب البلاغ تُفسح المجال لقدر لا بأس به من الشك، في حين أن تقييم هذه التهم والأدلة من جانب محاكم الدولة الطرف قد جرى على نحو يشكل خرقاً للضمانات المتعلقة بالمحاكمة المنصفة المنصوص عليها في الفقرة 3 من المادة 14.

(f) Both the author's son and counsel pointed out to the court that Mr. Tolipkhuzhaev was arrested on 13 September 2002, but was only brought to an investigation centre on 26 September 2002, instead of 16 September 2002 as required by law.
(و) أبلغ كل من نجل صاحب البلاغ ومحاميه المحكمة بأن السيد توليبخوجايف أوقِف في 13 أيلول/سبتمبر 2002 ولم يُحضَر إلى مركز التحقيق إلاّ في 26 أيلول/سبتمبر 2002، بدلاً من 16 أيلول/سبتمبر 2002 كما يقضي بذلك القانون.

7. The Human Rights Committee, acting under article 5, paragraph 4, of the Optional Protocol to the International Covenant on Civil and Political Rights, finds that the facts before it disclose violations of the rights of the author's son under article 7; article 9, paragraphs 1, 2 and 3; and article 14, paragraphs 1, 2, 3 (a), (b), (e) and (g), of the Covenant.
7- إن اللجنة المعنية بحقوق الإنسان، إذ تتصرف بموجب الفقرة 4 من المادة 5 من البروتوكول الاختياري الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية، ترى أن الوقائع المعروضة عليها تكشف عن حدوث انتهاك لحقوق نجل صاحب البلاغ بموجب المادة 7؛ والفقرات 1 و2 و3 من المادة 9؛ والفقرات 1 و2 و3(أ) و(ب) و(ﻫ) و(ز) مـن المادة 14 من العهد.
