“In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties, each Party to the conflict shall be bound to apply, as a minimum, the following provisions:

It sets out in straightforward terms a number of important protections that all parties to a conflict must respect, and applies to any armed conflict “not of an international character”.

In the case of armed conflict not of an international character occurring in the territory of one of the High Contracting Parties (i.e. internal), each Party to the conflict shall be bound to apply, as a minimum, the following provisions:

42. All parties to the conflict in Darfur are also bound by the provisions of international humanitarian law laid out in common article 3 to the four Geneva Conventions of 12 August 1949, which applies " in the case of armed conflict not of an international character " .
42- كما أن جميع أطراف الصراع الدائر في دارفور يجب أن تلتزم بأحكام القانون الإنساني الدولي المنصوص عليها في المادة 3 المشتركة بين اتفاقيات جنيف الأربع المؤرخة 12 آب/أغسطس 1949 والتي تنطبق " في حالة قيام نزاع مسلح ليس لـه طابع دولي " .

429. The Working Group reiterates that, in many cases where disappearances arise from conditions of armed conflict not of an international character, the way to an enduring and sustainable solution is for the international community to take concerted action aimed at tackling the root causes that give rise to such internal situations.
429- ويؤكد الفريق العامل من جديد أن كثير من حالات الاختفاء الناشئة عن أوضاع نزاع مسلح ليس لـه طابع دولي، تكون وسيلة إيجاد حل دائم ومستدام هي قيام المجتمع الدولي باتخاذ إجراءات متسقة ترمي إلى معالجة الأسباب الأساسية المؤدية إلى هذه الأوضاع المحلية.

Regarding the Government's reference to common article 3 of the Geneva Conventions of 12 August 1949, the Working Group would like to recall that this article is in reference to " armed conflict not of an international character " .
وفيما يتعلق بإشارة الحكومة إلى المادة 3 المشتركة في اتفاقيات جنيف المؤرخة 12 آب/أغسطس 1949، يود الفريق العامل أن يُذكّر بأن هذه المادة تشير إلى " نزاع مسلح ليس لـه طابع دولي " .

501. In many cases where disappearances arise from conditions of armed conflict not of an international character, the way to an enduring and sustainable solution is for the international community to take concerted action aimed at tackling the root causes that give rise to such internal situations.

31. The Statute of the International Criminal Court now provides in its Article 8, paragraph 2 (b) (iii) and (e) (iii), respectively, that in an international armed conflict and in an armed conflict not of an international character, the following constitutes a " war crime " :
٣١ - وينص النظام اﻷساسي للمحكمة الجنائية الدولية حاليا في المادة ٨، الفقرة ٢ )ب( ' ٣ ' و )ﻫ( ' ٣ ' ، على التوالي، أنه في أي نزاع مسلح دولي أو في أي نزاع مسلح ليس له طابع دولي، فإن اﻷمور التالية تشكل " جريمة حرب " :

Thus, common article 3 provides that in the case of an armed conflict not of an international character occurring in the territory of one of the High Contracting Parties to the Conventions, each party to the conflict shall be bound to apply, as a minimum, certain fundamental humanitarian provisions, and encourages the parties to the conflict to conclude special agreements to bring other provisions of the Conventions into force.
وعليه، فإن المادة 3 المشتركة تنص على أنه في حالة قيام نزاع مسلح ليس لـه طابع دولي في أراضي أحد الأطراف السامية المتعاقدة، يلتزم كل طرف في النزاع بأن يطبق كحد أدنى بعض الأحكام الإنسانية الأساسية، وتحث أطراف النزاع على أن توقع اتفاقات خاصة للتمكين من تنفيذ الأحكام الأخرى من هذه الاتفاقيات(19).

The Special Rapporteur accepts that while set out in article 1, paragraph 1, of Additional Protocol II, the requirements of organized command and " sustained and concerted military operations " , as opposed to " sporadic acts of violence " , are also requisites for application of common article 3 of the 1949 Geneva Conventions, which refers to " armed conflict not of an international character " .
وتوافق المقررة الخاصة على أن اشتراط وجود قيادة منظمة و " عمليات عسكرية متواصلة ومنسقة " كما ورد في البروتوكول الملحق الثاني، على عكس " أعمال العنف المتقطعة " (64)، هو أيضا شرط مسبق لسريان المادة 3 المشتركة بين اتفاقيات جنيف لعام 1949، حيث تشير المادة إلى " نزاع مسلح ليس له طابع دولي " (65).
