91. [The prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
91- [إن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية يتفق مع الحق في حرية الرأي والتعبير.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
4- وفي رأي اللجنة أن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

The Committee encourages the State party to comply with the requirements of article 4 of the Convention, in particular by declaring an offence punishable by law all dissemination of ideas based on racial superiority or hatred, and incitement to racial discrimination, as well as all acts of violence or incitement to such acts; and declaring illegal and prohibiting organizations which promote and incite racial discrimination.
تشجع اللجنة الدولة الطرف على امتثال متطلبات المادة 4 من الاتفاقية، ولا سيما من خلال جعل نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية، والتحريض على التمييز العنصري، إضافة إلى جميع أعمال العنف أو التحريض على هذه الأعمال جريمةً يعاقب عليها القانون؛ وإعلان المنظمات التي تروج للتمييز العنصري وتحرض منظمات غير قانونية ومنعها.

4. In the opinion of the Committee, the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression.
4- ورأي اللجنة أن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير.

The Committee also clearly stated that in its opinion, " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression " .
وذكرت اللجنة بوضوح أيضاً أنها ترى أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " (7).

CERD was fully aware of the related problems and stressed in general recommendation No. 15 that " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression. "
وكانت اللجنة واعية تمام الوعي بالصعوبات المتصلة بالتنفيذ، فشدّدت في توصيتها العامة رقم 15 على أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " .

11. In its General Recommendation 15, the Committee has asserted that " the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression. "
11- وأكدت اللجنة في توصيتها العامة الرابعة عشرة أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " .

11- وأكدت اللجنة في توصيتها العامة رقم 15 أن " حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير " .

Reaffirms that general comment No. 15 of the Committee on the Elimination of Racial Discrimination, in which the Committee stipulated that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with freedom of opinion and expression, is equally applicable to the question of incitement to religious hatred;
11- يؤكد من جديد أن التعليق العام رقم 15 للجنة القضاء على التمييز العنصري الذي تعتبر فيه اللجنة حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية منسجماً مع حرية الرأي والتعبير، ينطبق أيضاً على مسألة التحريض على الكراهية الدينية؛

12- يؤكد من جديد أن التعليق العام رقم 15 للجنة القضاء على التمييز العنصري الذي تعتبر فيه اللجنة حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية منسجماً مع حرية الرأي والتعبير، ينطبق أيضاً على مسألة التحريض على الكراهية الدينية؛

Reaffirms that general recommendation XV (42) of the Committee on the Elimination of Racial Discrimination, in which the Committee stipulated that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with freedom of opinion and expression, is equally applicable to the question of incitement to religious hatred;

While noting the State party's concerns in regard to freedom of speech, the Committee recalls that the prohibition of the dissemination of all ideas based upon racial superiority or hatred is compatible with the right to freedom of opinion and expression (arts. 2 and 4 of the Convention).
وبينما تلاحظ اللجنة شواغل الدولة الطرف فيما يتعلق بحرية التعبير، فإنها تذكِّر بأن حظر نشر جميع الأفكار القائمة على التفوق العنصري أو الكراهية العنصرية إنما ينسجم مع الحق في حرية الرأي والتعبير (المادتان 2 و4 من الاتفاقية).

(a) In the light of article 4 of the International Convention on the Elimination of All Forms of Racial Discrimination, what measures are being taken to prevent incitement to racial or ethnic hatred by any persons whatsoever (including by use of the Internet) and to declare punishable by law all dissemination of ideas based on racial superiority or hatred?
