It was agreed that because of the strong methodological interdependence among the statistics that belonged to the Core Set and the other two tiers of the Basic Set of Environment Statistics, the scope of the Manual should be extended to the entire Basic Set.

The International Labour Organization (ILO) had participated in the Working Group's discussion on the topic and the general consensus had been that since such contracts involved not only diverse national laws but also obligations under international treaties and conventions, to do more than raise them as a particularly complex issue exceeded the scope of the Guide.

Guideline 1.5 provided that unilateral statements constituting neither reservations nor interpretative declarations fell outside the scope of the Guide.

Mr. CHOUKRI (Observer for Morocco) pointed out an apparent contradiction between the first sentence of paragraph 7 of document A/CN.9/444/Add.1 and the third sentence of paragraph 2 of document A/CN.9/438/Add.1, both of which dealt with the scope of the Guide.

It was stated that the distinction made in the guide between privately financed infrastructure projects and other transactions for the " privatization " of state functions or property might not be justified in certain cases and that it was preferable not to exclude privatization transactions from the scope of the Guide.
وقيل إن التمييز الوارد في الدليل بين مشاريع الهياكل اﻷساسية ذات التمويل الخاص والمعاملات اﻷخرى ﻟ " خصخصة " وظائف أو ممتلكات الدولة قد لا يكون له ما يبرره في حالات معينة وأن من اﻷفضل عدم استبعاد معاملات الخصخصة من نطاق الدليل.

In order to avoid any overlap and conflict, the Commission decided that all securities should be excluded from the scope of the Guide (see A/62/17 (Part I), paras. 147 and 160).

5. The intent of draft recommendation 245 was to make it clear that even though recommendation 81 (c) provided a licensee with protection against the holder of a security right, it would be beyond the scope of the Guide to undermine the rights of a licensor under intellectual property law.

3. Mr. Marca Paco (Plurinational State of Bolivia), referring to paragraph 2 of the draft decision, said that it was important, when describing the entities to which the Guide would be transmitted, to include decision-making bodies other than courts in order to make the scope of the Guide clear.

The Commission also decided that payment rights arising from or under financial contracts governed by netting agreements, as well as from or under foreign exchange transactions, should also be excluded from the scope of the Guide, and that future work on financial contracts should be considered at a future session (ibid. paras. 147 and 161).
وقرّرت اللجنة أن تُستبعد أيضاً من نطاق الدليل حقوق السداد الناشئة عن العقود المالية الخاضعة لاتفاقات معاوضة أو بمقتضى تلك العقود، أو الناشئة عن معاملات الصرف الأجنبي أو بمقتضاها، وأن ينظر في دورة مقبلة في الأعمال التي سيضطلع بها مستقبلا بشأن العقود المالية (المرجع نفسه، الفقرتان 147 و161).
