As I reported last year, 191 States are parties to the Statute of the Court, and 66 of them have accepted the compulsory jurisdiction of the Court in accordance with Article 36, paragraph 2, of its statute.

I begin by recalling that currently 192 States are parties to the Statute of the Court, and that 67 of them have accepted the compulsory jurisdiction of the Court in accordance with Article 36, paragraph 2, of the Statute.

The Permanent Court of International Justice had declined only once to provide an advisory opinion, in the case concerning the Status of Eastern Carelia, on the grounds that, by giving an opinion, it would have had to pronounce on a bilateral dispute in which one of the parties was not a party to the Court's Statute.

However, concerns had been voiced that too rigid a jurisdictional scheme might deter some States from becoming parties both to the Statute of the Court and to the Charter of the United Nations, and also that the imposition of compulsory jurisdiction might unduly restrict the power of States to make reservations ratione temporis to their declarations recognizing the Court's jurisdiction as compulsory.

By a note dated 21 October 2004 addressed to the Security Council (S/2004/830), the Secretary-General referred to Judge Guillaume's letter of resignation and drew its attention to article 14 of the Statute of the Court regarding fixing the date of the election to fill the vacancy in the International Court of Justice.

3. By a note dated 15 March 2010 (S/2010/136), the Secretary-General referred to Judge Shi's letter of resignation and drew the attention of the Security Council to article 14 of the Statute of the Court regarding fixing the date of the election to fill the resulting vacancy in the Court.
3 - وأشار الأمين العام، في مذكرة مؤرخة 15 آذار/مارس 2010 (S/2010/136)، إلى رسالة استقالة القاضي شي، ووجه انتباه المجلس إلى المادة 14 من نظام المحكمة الأساسي المتعلقة بتحديد تاريخ الانتخاب لملء المنصب الشاغر في محكمة العدل الدولية.

His Government had made a declaration in 2008 recognizing the Court's jurisdiction as compulsory, pursuant to Article 36, paragraph 2, of the Court's Statute.
وذكر أن حكومة بلده أصدرت إعلانا في عام 2008 يعترف بإلزامية ولاية المحكمة، عملا بالفقرة الثانية من المادة 36 من نظام المحكمة الأساسي.

More importantly, Article 36, paragraph 2, of the Court's Statute provided that States could declare that they recognized as compulsory ipso facto and without special agreement, in relation to any other State accepting the same obligation, the jurisdiction of the Court in all legal disputes.

Moreover, membership of the United Nations did not automatically entail recognition of the Court's compulsory jurisdiction: the 70 States that had issued the necessary declaration pursuant to Article 36, paragraph 2, of the Court's Statute represented only just over a third of the Organization's membership.

That is what we hoped to achieve by establishing the International Criminal Court, the rules of which, including its statute and rules of procedure and evidence, guarantee fair trials, the rights of both the accused and the defence, and high international standards.

Furthermore, would such a delegation of administrative functions to the judges not conflict with the provisions of Article 16, paragraph 1, of the Statute of the International Court of Justice, made applicable by the Tribunal's statute to judges of the Tribunal, by which " no member of the court may exercise any... administrative function... " ?

I also consider that Mr. Parker's appointment would be well calculated to ensure adequate representation on the Tribunal of the principal legal systems of the world, as contemplated in article 13 bis (1) (c) of the Tribunal's statute.
وأرى أيضا أن تعيين السيد باركير يفي بالغرض حق الوفاء بحيث يكفل مبدأ تمثيل النظم القانونية الرئيسية في العالم تمثيلا ملائما في المحكمة على النحو المتوخى في الفقرة 1 (ج) من المادة 13 مكررا من نظام المحكمة الأساسي.
