In other words, if this basic condition is met (absence of a contrary intention on the part of the author of the reservation), the treaty is presumed to have entered into force for the author without the benefit of the reservation - provided that the treaty has effectively entered into force in respect of the other contracting States and contracting organizations.
وهذا يعني، في إطار هذا الشرط الأساسي (عدم وجود نية مخالفة لدى صاحب التحفظ)، افتراض أن المعاهدة قد بدأ نفاذها بالنسبة إلى صاحب التحفظ دون الاستفادة من التحفظ() - ولكن بشرط أن تكون المعاهدة قد بدأ نفاذها بالنسبة للدول المتعاقدة والمنظمات المتعاقدة الأخرى.

The objection may in fact have several different effects, both on the entry into force of the treaty (as described in guidelines 4.3.1 to 4.3.4) and, once the treaty has entered into force for the author of the reservation and the author of the objection, on the content of the treaty relations thus established (dealt with in guidelines 4.3.5 to 4.3.7).
إذ يمكن أن تنتج عن الاعتراض عدة آثار مختلفة سواء فيما يتعلق ببدء نفاذ المعاهدة (وهو ما توضحه المبادئ التوجيهية 4-3-1 إلى 4-3-4) أو، متى كانت المعاهدة قد بدأ نفاذها بالنسبة إلى صاحب التحفظ وصاحب الاعتراض، فيما يتعلق بمضمون العلاقات التعاهدية المنشأة على هذا النحو (وهو الأمر الذي تتناوله المبادئ التوجيهية 4-3-5 إلى 4-3-7).

In other words, if this basic condition is met (absence of a contrary intention on the part of the author of the reservation), the treaty is presumed to have entered into force for the author -- provided that the treaty has entered into force in respect of the contracting States and contracting organizations -- and the reservation has no legal effect on the content of the treaty, which applies in its entirety.
وهذا يعني، في إطار هذا الشرط الأساسي (عدم وجود نية مخالفة لدى صاحب التحفظ)، افتراض أن المعاهدة قد بدأ نفاذها بالنسبة إلى صاحب التحفظ - ولكن بشرط أن تكون المعاهدة قد بدء نفاذها بالنسبة للدول المتعاقدة والمنظمات المتعاقدة - وأن التحفظ لا ينتج أي أثر قانوني على مضمون المعاهدة()؛ إذ إنها تطبق برمّتها.
