٣ - يجوز ﻷي دولة طرف أن تعلن، وقت توقيع هذه الاتفاقية أو التصديق عليها أو قبولها أو الموافقة عليها أو الانضمام إليها، أنها لا تعتبر نفسها ملزمة بالتقيد بأي من إجرائي تسوية النزاعات، المنصوص عليهما في الفقرة ٢ أعلاه، أو بكليهما.

٢ - يجوز ﻷي دولة أن تعلن، لدى التوقيع على هذه الاتفاقية أو التصديق عليها أو قبولها أو الموافقة عليها أو لدى الانضمام إليها، أنها لا تعتبر نفسها ملزمة بالتقيد بعرض هذا النزاع على التحكيم المنصوص عليه في الفقرة ١.

12. UNHCR and CEDAW were concerned that Bahamas did not see itself bound by the provisions of article 9, paragraphs 1 and 2, of the Convention, based on a Constitutional Referendum vote against the withdrawal of the provision preventing women from passing their nationality to their children or to their spouses of foreign nationality.
12- وشعرت المفوضية السامية لشؤون اللاجئين واللجنة المعنية بالقضاء على التمييز ضد المرأة بالقلق لأن جزر البهاما لا تعتبر نفسها ملزمة بالتقيد بأحكام الفقرتين (1) و(2) من المادة 9 من الاتفاقية، بحجة أن مواطني جزر البهاما صوَّتوا، في استفتاء دستوري، ضد حذف النص الدستوري الذي يمنع المرأة من منح جنسيتها لأبنائها أو لزوجها الذي يحمل جنسية أجنبية(31).
