في حال عدم التمكن من إتمام نقل عبر الحدود لنفايات خطرة وغيرها من النفايات والتي مُنحت موافقة البلدان المعنية، فإن بلد التصدير سيضمن عودة النفايات محل السؤال إلى بلد التصدير للتخلص منها إذا كان لا يمكن عمل ترتيبات بديلة.

The recent South Pacific Forum in Brisbane, Australia, among others, reaffirmed its support for the negotiation of a convention to ban the importation into Forum island countries of hazardous wastes and to control their transboundary movement and management within the South Pacific region, and it welcomed the progress made in that regard.
إن محفل جنوب المحيط الهادئ في اجتماعه اﻷخير في بريسباني باستراليا، أكد من جديد، في جملة أمور، على دعمه التفاوض على اتفاقية تحظر استيراد النفايات الضارة إلى بلدان المحفل الجزرية وتحد نقل عبر الحدود والسيطرة عليها في منطقة جنوب المحيط الهادئ، وقد رحب بالتقدم المحرز في هذا الصدد.

5. In the case of a transboundary movement of wastes where the wastes are legally defined as or considered to be hazardous wastes only:

51- في حال عدم التمكن من إتمام نقل عبر الحدود لنفايات خطرة وغيرها من النفايات والتي مُنحت موافقة البلدان المعنية، فإن بلد التصدير سيضمن عودة النفايات محل السؤال إلى بلد التصدير للتخلص منها إذا كان لا يمكن عمل ترتيبات بديلة.

(a) Electronic waste is a growing and critical concern as a result of its illegal dumping, which results in the transboundary movement of its hazardous constituents such as heavy metals and brominated flame retardants;
(أ) النفايات الإلكترونية هي مبعث انشغال متزايد وخطير نتيجة للإلقاء غير المشروع، الأمر الذي يفضي إلى نقل عبر الحدود لمكوناتها الخطرة مثل الفلزات الثقيلة ومثبطات اللهب المحتوية على البروم؛

No transboundary movements of hazardous wastes and other wastes are permitted between a Party and a non-Party to the Basel Convention unless a bilateral, multilateral or regional arrangement exists as required under Article 11 of the Basel Convention.
