3. If a State Party that makes extradition conditional on the existence of a treaty receives a request for extradition from another Party with which it has no extradition treaty, it may consider this Convention as the legal basis for extradition in respect of any offence to which this article applies.
3 - اذا تلقت دولة طرف تخضع تسليم المجرمين لوجود معاهدة، طلبا بشأن تسليم المجرمين من دولة طرف أخرى لم تبرم معها معاهدة لتسليم المجرمين، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يتعلق بأي جريمة تنطبق عليها هذه المادة.

2. If a State Party which makes extradition conditional on the existence of a treaty receives a request, for extradition from another State Party with which it does not have an extradition treaty, it may, if it decides to extradite, consider this Convention as the legal basis for extradition in respect of those crimes.
2 - إذا تلقت دولة من الدول الأطراف تعلق تسليم المجرمين على شرط وجود معاهدة طلبا بتسليم المجرمين، من دولة أخرى من الدول الأطراف لا ترتبط معها بمعاهدة لتسليم المجرمين، فلها، إذا قررت التسليم، اعتبار هذه الاتفاقية الأساس القانوني للتسليم بخصوص الجرائم المبينة.

(b) If it does not take this Convention as the legal basis for cooperation on extradition, seek, where appropriate, to conclude treaties on extradition with other States Parties to this Convention in order to implement this article.
(ب) وأن تسعى، حيثما اقتضى الأمر، إلى إبرام معاهدات تسليم مع سائر الدول الأطراف في هذه الاتفاقية بغية تنفيذ هذه المادة، إذا كانت لا تعتبر هذه الاتفاقية الأساس القانوني للتعاون بشأن التسليم.

4. 4- إذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة لتسليم المجرمين، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يتعلق بأي جرم تنطبق عليه هذه المادة.

5. 5- إذا تلقت دولة طرف، تجعل تسليم المجرمين مشروطا بوجود معاهدة، طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يخص أي جرم تنطبق عليه هذه المادة.

Pursuant to article 16, paragraph 4, of the Organized Crime Convention, States parties that make extradition conditional on the existence of a treaty (usually States with a common-law tradition) may consider the Convention the legal basis for extradition in their relations with other States parties.
وعملاً بالفقرة 4 من المادة 16 من اتفاقية الجريمة المنظمة، يجوز للدول الأطراف التي تجعل تسليم المجرمين مشروطاً بوجود معاهدة (وهي عادة الدول التي درجت تقليدياً على العمل بالقانون العام) أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم في علاقاتها مع الدول الأطراف الأخرى.

(b) If it does not take this Convention as the legal basis for cooperation on extradition, seek, where appropriate, to conclude treaties on extradition with other States Parties to this Convention in order to implement this article.
(ب) أن تسعى، حيثما اقتضى الأمر، إلى إبرام معاهدات تسليم مع سائر الدول الأطراف في هذه الاتفاقية بغية تنفيذ هذه المادة، إذا كانت لا تعتبر هذه الاتفاقية الأساس القانوني للتعاون بشأن التسليم.

(a) At the time of deposit of its instrument of ratification, acceptance or approval of or accession to this Convention, inform the Secretary-General of the United Nations whether it will take this Convention as the legal basis for cooperation on extradition with other States Parties to this Convention; and
(أ) أن تبلّغ الأمين العام للأمم المتحدة، وقت إيداعها صك التصديق على هذه الاتفاقية أو قبولها أو إقرارها أو الانضمام إليها، بما إذا كانت ستعتبر هذه الاتفاقية الأساس القانوني للتعاون بشأن التسليم مع سائر الدول الأطراف في هذه الاتفاقية؛

(a) At the time of deposit of its instrument of ratification, acceptance, approval of or accession to this Convention, inform the Secretary-General of the United Nations whether it will take this Convention as the legal basis for cooperation on extradition with other States Parties to this Convention; and
(أ) أن تبلّغ الأمين العام للأمم المتحدة، وقت إيداعها صك التصديق على هذه الاتفاقية أو قبولها أو إقرارها أو الانضمام إليها، بما إذا كانت ستعتبر هذه الاتفاقية الأساس القانوني للتعاون بشأن التسليم مع سائر الدول الأطراف في هذه الاتفاقية؛

Such concerns were repeated in plenary in the final debate on the draft convention and, following a heated discussion, the proposal was amended to provide that the State concerned " may at its option consider this Convention as the legal basis for extradition in respect of the offence " (emphasis added).
وأثيرت هذه المخاوف من جديد في اجتماع عام حين المناقشة النهائية لمشروع الاتفاقية، وبعد نقاشات حامية، عُدّل الاقتراح لينص على أن للدولة المعنية " الخيار في اعتبار هذه الاتفاقية الأساس القانوني للتسليم فيما يخص الجريمة " (التأكيد مضاف)().

5- إذا تلقت دولة طرف تجعل تسليم المجرمين مشروطا بوجود معاهدة طلب تسليم من دولة طرف أخرى لا ترتبط معها بمعاهدة تسليم، جاز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم فيما يتعلق بأي جرم تُطبق عليه هذه المادة.

It should be noted that article 16, paragraph 4, of the Organized Crime Convention states that States parties that make extradition conditional on the existence of a treaty (usually States with a common law tradition) may consider the Convention the legal basis for extradition in their relations with other parties.
27- وتجدر الإشارة إلى أنّ الفقرة 4 من المادة 16 من اتفاقية الجريمة المنظمة تنص على أنّ الدول الأطراف التي تجعل تسليم المجرمين مشروطا بوجود معاهدة (وهي عادة الدول التي درجت تقليديا على العمل بالقانون العام) يجوز لها أن تعتبر هذه الاتفاقية الأساس القانوني للتسليم في علاقاتها مع الأطراف الأخرى.
