The Government Sweden is of the view that these general reservations raise doubts as to the commitment of Brunei Darussalam to the object and purpose of the Convention and would recall that, according to article 51, paragraph 2, of the Convention, a reservation incompatible with the object and purpose of the Convention shall not be permitted.

However, article 28 of the Convention provides, inter alia: " A reservation incompatible with the object and purpose of the present Convention shall not be permitted. "
بيد أن المادة ٨٢ من الاتفاقية تنص ضمن جملة أمور على أنه: " لا يجوز إبداء أي تحفظ يكون منافياً لموضوع هذه الاتفاقية وغرضها " .

In the text of the draft Convention contained in document A/AC.254/4/Rev.5, a provision that was relevant to this possible option was included as paragraph 4, namely: “A reservation incompatible with the object and purpose of the present Convention shall not be permitted.”
وفي نص مشروع الاتفاقية، الوارد في الوثيقة A/AC.254/4/Rev.5، أدرج حكم يتعلق بهذا الخيار الثالث المحتمل، في الفقرة ٤، وهو: " لا يُسمح بأي تحفظ يتنافى مع هدف هذه الاتفاقية وغرضها " .

A reservation incompatible with the object and purpose of this Convention shall not be permitted, nor shall a reservation the effect of which would inhibit the operation of any of the bodies established by the Convention be allowed. A reservation shall be considered inhibitive if at least two thirds of the States Parties to this Convention object to it.
لا يجوز إبداء أي تحفظ يكون منافيا لموضوع هذه الاتفاقية وغرضها أو مؤديا إلى تعطيل عمل أي هيئة من الهيئات المنشأة بموجبها، ويعتبر التحفظ المعني كذلك، إذا اعترض عليه ما لا يقل عن ثلثي الدول الأطراف في هذه الاتفاقية.

The Government of Finland is of the view that such a general reservation raises doubts as to the commitment of Pakistan to the object and purpose of the Convention and would recall that, according to paragraph 2 of article 28 of the Convention, a reservation incompatible with the object and purpose of the Convention shall not be permitted.
