وبهدف تعزيز مشاركة الشركات الأجنبية ومضاعفة التنافس، قد ترغب السلطة المتعاقدة في أن تعلن الدعوة إلى إجراءات الاختيار الأولي كذلك بالأسلوب المستخدم عادة في التجارة الدولية، في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية أو مجلة تقنية أو مهنية متخصصة ذات صلة وواسعة الانتشار دوليا.

وبهدف تعزيز مشاركة الشركات اﻷجنبية ومضاعفة التنافس ، قد ترغب الهيئة المتعاقدة في أن تنشر الدعوة الى اجراءات الاختيار اﻷولي كذلك باﻷسلوب المستخدم عادة في التجارة الدولية ، في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية أو مجلة تقنية أو مهنية متخصصة ذات صلة وواسعة الانتشار دوليا .

(2) The invitation to tender or invitation to prequalify shall also be published, in a language customarily used in international trade, in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation.
)٢( تنشر الدعوة الى تقديم العطاءات أو طلبات التأهيل أيضا بلغة تستخدم عادة في التجارة الدولية، في صحيفة واسعة الانتشار دوليا أو في نشرة متخصصة أو مجلة تقنية أو مهنية ذات صلة وواسعة الانتشار دوليا.

(3) The procuring entity shall publish in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation the first notice soliciting submittals of proposals. The notice must set out, at least:
(3) تنشر الجهة المشترية في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية أو مجلة تقنية أو مهنية ذات صلة وواسعة الانتشار دوليا الإشعار الأول بشأن التماس تقديم الاقتراحات، على أن يتضمن هذا الإشعار ما يلي على الأقل:

(2) The invitation shall also be published in a language customarily used in international trade, in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation.
(2) تُنشَر الدعوة أيضا بلغة شائعة الاستخدام في التجارة الدولية، أو في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية ذات صلة أو مجلة تقنية أو مهنية واسعة الانتشار دوليا.

19. Article 24 of the UNCITRAL Model Law requires that participation in a procurement must be advertised by publication in a place specified by the enacting State when implementing the UNCITRAL Model Law and (for international procurements) a " newspaper " or " relevant trade publication or technical or professional journal " of wide international circulation.
19- وتقضي المادة 24 من قانون الأونسيترال النموذجي بالإعلان عن المشاركة في الاشتراء بواسطة نشرها في مكان تحدّده الدولة المشترعة عند تطبيق قانون الأونسيترال النموذجي وفي " صحيفة " أو " نشرة متخصصة أو مجلة تقنية أو مهنية ذات صلة " واسعة الانتشار دوليا (بالنسبة لعمليات الاشتراء الدولية).

To address the concerns of the observers, it was agreed that the Guide would explain that the revised text was technologically neutral (whereas the previous wording implied the use of paper-based media, by referring to a newspaper or a journal of wide international circulation) and was intended to accommodate modern methods of publication.
98- وتبديداً لشواغل هذين المراقبين، اتُّفق على أن يَشرَح الدليلُ أنَّ النص المنقَّح محايد تكنولوجيا (في حين أنَّ الصيغة السابقة تقتضي ضمنا استخدام وسائط الإعلام الورقية بإشارتها إلى نشر الدعوة في صحيفة أو مجلة واسعة الانتشار دوليا) وأنَّ القصد منه أخذ وسائل النشر الحديثة بعين الاعتبار.

Unless decided otherwise by the procuring entity in the circumstances referred to in article 32 (4) of this Law, the invitation to pre-qualify shall also be published, in a language customarily used in international trade, in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation.
وتُنشر الدعوة إلى التأهل الأولي أيضا، بلغة تُستخدَم عادة في التجارة الدولية، في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية ذات صلة أو مجلة تقنية أو مهنية واسعة الانتشار دوليا، ما لم تقرر الجهة المشترية خلاف ذلك في الظروف المشار إليها في المادة 32 (4) من هذا القانون.

In view of the objective of the UNCITRAL Model Law of fostering participation in procurement proceedings without regard to nationality and maximizing competition, article 24(2) requires publication of the invitations to prequalify also in a language customarily used in international trade, in a newspaper of wide international circulation or in a relevant trade publication or technical or professional journal of wide international circulation.
وبالنظر الى الهدف الذي يتوخاه قانون اﻷونسيترال النموذجي من تشجيع للمشاركة في اجراءات الاشتراء ، بصرف النظر عن الجنسية وبقصد زيادة المنافسة الى أقصى حد ، تقتضي المادة ٤٢ )٢( نشر دعوات التقدم الى الاثبات المسبق لﻷهلية بلغة تستخدم عادة في التجارة الدولية ، في صحيفة واسعة الانتشار دوليا أو في نشرة تجارية أو مجلة تقنية أو مهنية متخصصة وواسعة الانتشار دوليا .
