Mr. Giralt (El Salvador), referring to the protection of persons in the event of disasters, said that draft article 1 (Scope) was lacking in content and could be improved by the inclusion of a short summary of the rich material on scope ratione materiae, ratione personae, ratione temporis and ratione loci contained in the commentary to that article.

It could be applied as a last resort in the absence of other bases for jurisdiction, such as territoriality and active or passive personality, and required the individual in question to be present in the territory of the forum State.
