The Working Group noted that its work on electronic contracting was evolving against the background of earlier instruments that had been prepared by the Commission, in particular the United Nations Sales Convention and the UNCITRAL Model Laws on Electronic Commerce and electronic signatures.

The Secretariat was requested to introduce wording to make it abundantly clear that the " duality " to be avoided would be the result of discrimination between electronic signatures used domestically and electronic signatures used in the context of international trade transactions.
وطلب إلى الأمانة العامة أن تضع صيغة حتى يتضح تماما أن مسألة " وجود نظامين " التي يجب تفاديها ستكون نتيجة التمييز بين التوقيعات الالكترونية المستخدمة محليا والتوقيعات الالكترونية المستخدمة في سياق المعاملات التجارية الدولية.

Paragraph (1) was a rule of non-discrimination formulated in negative terms, whereas paragraphs (2) and (3) developed that general rule in more concrete terms by positively affirming that foreign certificates and electronic signatures should be given legal effect when substantially equivalent to domestic ones in terms of their reliability.
فالفقرة (1) هي قاعدة عدم تمييز صيغت بشكل سلبي، بينما استحدثت الفقرتان (2) و(3) تلك القاعدة العامة بشكل أكثر رسوخا بتأكيدهما تأكيدا إيجابيا على أنه ينبغي اعطاء الشهادات والتوقيعات الالكترونية الأجنبية مفعولا قانونيا عندما تكون معادلة جوهريا للشهادات والتوقيعات المحلية من حيث موثوقيتها.

In that connection, it was pointed out that, as the uniform rules no longer distinguished between electronic signatures and enhanced electronic signatures, the duties and obligations of signatories, relying parties and certification service providers set forth in the uniform rules applied with respect to all classes and types of certificates and electronic signatures.
وأشير في ذلك الخصوص الى أنه، نظرا لكون مشروع القواعد الموحدة لم يعد يميّز بين التوقيعات الالكترونية والتوقيعات الالكترونية المعززة، فإن واجبات والتزامات الموقّعين والأطراف المعوّلة ومقدمي خدمات التصديق، التي هي مبينة في مشروع القواعد الموحدة تنطبق على جميع فئات وأنواع الشهادات والتوقيعات الالكترونية.

The suggestion was made that the uniform rules should include a definition of " recognized international standards " , an expression which was used in connection with the recognition of foreign certificates and electronic signatures (see above, paras. 46-49).
101- قدم اقتراح مؤداه أن القواعد الموحدة ينبغي أن تشتمل على تعريف " المعايير الدولية المعترف بها " ، وهو تعبير يستخدم فيما يتعلق بالاعتراف بالشهادات والتوقيعات الالكترونية الأجنبية (أنظر أعلاه، الفقرات 46-49).

Discrimination between electronic signatures used domestically and electronic signatures used in the context of international trade transactions might result in a duality of regimes governing the use of electronic signatures, thus creating a serious obstacle to the use such techniques (see A/CN.9/484, para. 55).

Paragraph (4) was eventually turned into an unspecific reference to " any relevant factor " , among which the factors listed under articles 6, 9 and 10 for the assessment of domestic certificates and electronic signatures are particularly important.
