In this connection, the State party refers to the European Court's consideration in the authors' applications that they did not disclose any appearance of a violation of the rights and freedoms set out in the Convention.

2.10 On 27 September 2001, the European Court declared the application inadmissible under article 35, paragraph 4, of the Convention, as it did not disclose any appearance of a violation of the rights and freedoms set out in the Convention.

Under article 14, states parties must secure on their territories the enjoyment of the rights and freedoms set forth in the Convention without discrimination on any ground, including sex.

Regarding the author's other complaints, the Commission considered that they " [did] not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols. "

The obligation to secure, in such an area, the rights and freedoms set out in the Convention derives from the fact of such control, whether it be exercised directly, through its armed forces, or through a subordinate local administration " .

4.3 The State party further submits that the author submitted his complaint to the ECHR, which found his application inadmissible as " it did not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols " .

It considers that, in the present case, the European Court proceeded beyond an examination of purely procedural admissibility criteria, finding that the author's application " [did] not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols " .

As a preliminary remark, it noted that, on 14 November 2000, the European Court of Human Rights had found this case inadmissible, because it did " not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols " .

Rather, the Court's finding that the matters complained of " do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols " clearly shows that the Court's examination also comprised " a farreaching analysis of the merits of the case " .

6.2 The Committee notes that the European Court of Human Rights already examined the facts of this case and found " that they do not disclose any appearance of a violation of the rights and freedoms set out in the Convention to its Protocols " .

The Court's reasoning that " there is no appearance of a violation of the applicant's rights " and that the matters complained of " do not disclose any appearance of a violation of the rights and freedoms set out in the Convention or its Protocols " clearly showed that the decision to dismiss the application on grounds of admissibility " also comprises far reaching aspects on the merits " .

2.6 On 26 February 1999, an application by Ms. Palandjian to the European Court of Human Rights was declared inadmissible, in the light of all the materials in its possession, and insofar as the matters complained of were within its competence, the Court found that they did not disclose any appearance of a violation of the rights and freedoms set out in the Convention to its Protocols.
2-6 وفي 26 شباط/فبراير 1999، قررت المحكمة الأوروبية لحقوق الإنسان، على ضوء جميع الوثائق التي كانت بحوزتها، عدم قبول ادعاء تقدمت به السيدة بالاندجيان. وباعتبار أن المسائل المعروضة على المحكمة تدخل ضمن صلاحياتها فإنها خلصت إلى أن هذه المسائل لا تكشف عن أي دلائل على وقوع انتهاك للحقوق والحريات المنصوص عليها في الاتفاقية أو في البروتوكولات الملحقة بها.

This provision not only recalls the general obligation of respect for human rights; it internalizes that obligation by guaranteeing enjoyment of the rights and freedoms set forth in the Convention to anyone within the jurisdiction of the High Contracting Parties.
