In 1998, the Supreme Court had ruled that the Matrimonial and family relations Act must be brought into line with the Covenant, since it did not guarantee equal rights to judicial protection and treated children differently, depending on whether or not their parents were divorced.
وفي عام 1998، قررت المحكمة العليا وجوب جعل قانون الزواج والعلاقات الأُسرية يتماشى مع العهد لأنه لم يكن يضمن المساواة في الحقوق في الحماية القضائية وكان يميِّز بين الأطفال في المعاملة بناءً على كون أبويهم مطلَّقين أو غير مطلَّقين.

Article 16. Marriage and family relations
المادة 16 - الزواج والعلاقات الأُسرية

Personal laws should embody the fundamental principle of equality between women and men and should be fully harmonized with the provisions of the Convention so as to eliminate all discrimination against women in all matters relating to marriage and family relations.
وينبغي أن يتجسد في قوانين الأحوال الشخصية المبدأ الأساسي للمساواة بين المرأة والرجل، وينبغي جعلها متوائمة تواؤما تاما مع أحكام الاتفاقية بغية القضاء على جميع أشكال التمييز ضد المرأة في جميع الأمور المتصلة بالزواج والعلاقات الأُسرية.

241. In accordance with articles 2, 7 and 8 of the Convention and referring to the recommendation contained in paragraph 6 above, the Committee recommends that the State party, taking into account the principle of the best interests of the child, ensure the respect of the right of all children to preserve her or his identity, including all elements which constitute the identity of the child such as nationality, name and family relations.
241- وفقاً للمواد 2 و7 و8 من الاتفاقية، وبالإشارة إلى التوصية الواردة في الفقرة 6 أعلاه، توصي اللجنة بأن تضمن الدولة الطرف، آخذة في اعتبارها مبدأ مصالح الطفل الفُضلى، احترام حق جميع الأطفال في الحفاظ على هويتهم، بما في ذلك جميع العناصر التي تشكِّل هوية الطفل، مثل الجنسية والاسم والعلاقات الأُسرية.
