59. In light of the comments made, it was suggested that the chapeau and subparagraphs (i) and (ii) of paragraph (4)(a) redraft should be revised as follows:

It was also noted that there was some duplication between draft article 14 and subparagraphs (j) and (l) of draft article 21, which also covered issues related to the privacy of medical records.

312. The extensive commentary to article 50 begins by noting the overlap between subparagraph (e) and subparagraphs (a) and (d), which are justified because of the need to avoid arguments about the peremptory character of these particular norms.

8.3 The author has alleged a violation of article 14, paragraphs 1 and 2 and subparagraphs 3 (b) and (e), in that the non-disclosure, by the prosecution, of the statement made by Mr. Wilson to the police, denied him the possibility of cross-examining witnesses on the same terms as the prosecution and thus denied him adequate facilities for the preparation of his defence.
٨-٣ - وادعى الشاكي انتهاكا للفقرتين ١ و٢ والفقرتين الفرعيتين ٣ )ب( و)ﻫ( من حيث أن عدم كشف النيابة للشرطة عن إقرار السيد ويلسون حرمه من إمكانية استجواب الشهود على قدم المساواة مع النيابة، وبذا حرمه من التسهيلات الكافية ﻹعداد دفاعه.

The Conference of the Parties shall determine whether the proposal would contribute to the achievement of Article 2 of the Convention and the shared vision set out in Article 2 of this Protocol, taking into account the need to ensure consistency and transparency with regard to the measurable, reportable and verifiable nature of the targets agreed pursuant to this sub-paragraph and sub-paragraphs (a) and (b) above.
