The authors appealed to the Government to take all necessary measures to guarantee his right not to be deprived arbitrarily of his liberty and to fair proceedings before an independent and impartial tribunal, and furthermore urged the Government to suspend the sentence of capital punishment pronounced against him until all allegations relating to the absence of trial and the recourse to torture had been thoroughly investigated.

Recalling the Committee's concerns and recommendations regarding the State Security Court and the use of torture, ill-treatment and illegal, administrative and incommunicado detention in its concluding observations in 1994 (CCPR/C/79/Add.35, paras. 6 and 16), he noted that the State party had indicated that offences under anti-terrorism legislation could be taken to the highest appeal court and that the judiciary was independent.

2.10 The poor conditions in Abu-Salim prison have been widely documented. A report by the United Nations Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment indicates that prison conditions were harsh and that the lack of adequate food, medical care and the use of torture and other forms of ill-treatment had resulted in the deaths of prisoners.
