On 23 October 2001, the Court delivered its judgment on the application of the Philippines for permission to intervene in the case and found that it could not grant such permission since the Philippines had failed to show that it had an interest of a legal nature specific to its claim that might be affected by the final judgment in the case.

In December 2002, the Court rendered its Judgment in the case concerning sovereignty over Pulau Ligitan and Pulau Sipadan (Indonesia/Malaysia) in which it found that the 1891 Convention between Great Britain and the Netherlands, on which Indonesia based its claim to sovereignty over the islands, could not be taken to establish a title to sovereignty and that neither of the parties had obtained title to Ligitan and Sipadan by succession.
