14. Activities that promote and incite racial and religious discrimination are prohibited.

The Committee recommends that the State party ensure that its new criminal law is comprehensive and in full compliance with the provisions of article 4 of the Convention, declaring illegal and prohibiting organizations that promote and incite racial discrimination.
وتوصي اللجنة بأن تتأكد الدولة الطرف من أن قانونها الجنائي الجديد شامل ومطابق تماماً لأحكام المادة 4 من الاتفاقية، وينص على أن المنظمات التي تدعو إلى التمييز العنصري وتحرض عليه منظمات غير قانونية ينبغي حظرها.

75. The Committee expresses its concern that article 4 of the Convention is not fully complied with, since there is no provision in the Finnish legislation prohibiting and punishing organizations which promote and incite racial discrimination.

The Committee urges the State party to consider reviewing this provision and to declare punishable any participation in organizations that promote and incite racial discrimination, in accordance with article 4 (b) of the Convention.
وتحث اللجنة الدولة الطرف على أن تنظر في مراجعة هذا الحكم وأن تجعل أي مشاركة في منظمات تروج التمييز العنصري وتحرض عليه عملاً قابلاً للعقاب، وفقاً لأحكام المادة 4(ب) من الاتفاقية.

It expressed concern at the absence of legislation on racial discrimination in the civil and administrative fields and noted the absence of provisions declaring illegal and prohibiting organizations which promote and incite racial discrimination.

The Committee recommends that the State party revise its Criminal Code in order to introduce and implement a specific provision in full compliance with article 4 of the Convention that prohibits dissemination of ideas based on racial superiority or hatred, incitement of racial hatred and discrimination, and prohibition of organizations which promote and incite racial discrimination.
توصي اللجنة الدولة الطرف بأن تراجع قانون العقوبات على نحو تستحدث معه وتنفذ حكماً محدداً، يتوافق كلياً مع المادة 4 من الاتفاقية، ويحظر نشر الأفكار القائمة على التفوق العرقي أو الكراهية العرقية، والتحريض على الكراهية العنصرية والتمييز العنصري، ويحظر المنظمات التي تشجع التمييز العنصري وتحرض عليه.

The Committee reiterates its concern at the absence of a law prohibiting organizations which promote and incite racial discrimination and of a provision in the Penal Code declaring any dissemination of ideas based on racial superiority or hatred punishable by law.

(b) Have steps been taken to declare illegal and to prohibit organizations, which promote and incite racial discrimination, and has participation in such organizations and activities been criminalized in domestic law?
(ب) هل اُتخذت خطوات لإعلان عدم مشروعية المنظمات التي تشجع التمييز العنصري وتحرض عليه وحظر هذه المنظمات، وهل يجرّم القانون الداخلي الاشتراك في هذه المنظمات والأنشطة؟

The Committee also recommends that the Government provide in its next periodic report information, including the number of complaints lodged and sentences passed, about the implementation in practice of the legal provisions prohibiting acts of racial discrimination and organizations which promote and incite racial discrimination, in accordance with articles 2 and 4 of the Convention.
٣٦٨ - وتوصي اللجنة أيضا بأن تقدم الحكومة في تقريرها الدوري التالي معلومات عن التنفيذ الفعلي لﻷحكام القانونية التي تحظر أعمال التمييز العنصري، وعن المنظمات التي تروج للتمييز العنصري وتحرض عليه وفقا للمادتين ٢ و ٤ من الاتفاقية، وأن تشمل تلك المعلومات عدد الشكاوى المرفوعة واﻷحكام الصادرة.

In this respect, the Committee draws the State party's attention to its general recommendation XV according to which all provisions of article 4 of the Convention are of a mandatory character, including declaring illegal and prohibiting all organizations promoting and inciting racial discrimination.
وفي هذا الصدد، تسترعي اللجنة انتباه الدولة الطرف إلى توصيتها العامة الخامسة عشرة التي تنص على أن كل الأحكام الواردة في المادة 4 من الاتفاقية هي ذات طابع إلزامي، بما فيها حظر المنظمات التي تروج للتمييز العنصري وتحرض عليه وإعلانها منظمات غير قانونية.
