40. Article 33, paragraph 2, of the Convention recognized the important role of independent human rights institutions and required States parties to establish a framework to promote, protect and monitor implementation of the Convention.
40 - وأضاف قائلاً إن الفقرة 2 من المادة 33 من الاتفاقية تقرّ بأهمية دور المؤسسات المستقلة لحقوق الإنسان وتطلب من الدول الأطراف أن تضع إطاراً لتعزيز الاتفاقية وحمايتها ورصد تنفيذها.

2. States Parties shall, in accordance with their legal and administrative systems, maintain, strengthen, designate or establish within the State Party, a framework, including one or more independent mechanisms, as appropriate, to promote, protect and monitor implementation of the present Convention.

In that regard, the Government of Azerbaijan suggested that an additional protocol to the Convention providing specific guidelines on formation and implementation of the national mechanisms to promote, protect and monitor the implementation of the Convention should be adopted.

3. EU Framework for promoting, protecting and monitoring the CRPD

37. Article 33, paragraph 2 of the Convention requires States to have or put in place at national level a framework that includes one or more independent mechanisms, to promote, protect and monitor implementation of the Convention.

Beside appointment of a single independent mechanism to carry out functions under article 33, paragraph 2, the Convention also foresees the possibility that more than one independent mechanism be appointed in the framework, as appropriate, with the effect that States in fact establish a " mechanism of mechanisms " to promote, protect and monitor implementation.

17. In accordance with article 33, paragraph 2, States are required to maintain, strengthen, designate or establish at the national level a framework that includes one or more independent mechanisms, to promote, protect and monitor implementation of the Convention.

241. With regard to the establishment of an independent mechanism to promote, protect and monitor implementation of the Convention, the Higher Committee on Human Rights and Fundamental Freedoms has agreed to undertake that role in its capacity as an independent rights-related body.

31. Article 33, paragraph 2, also foresees the possibility that more than one independent mechanism might be appointed in the framework, as appropriate, with the effect that States would in fact establish a " mechanism of mechanisms " to promote, protect and monitor implementation.

65. The establishment of an independent monitoring mechanism to promote, protect and monitor implementation of the Convention is a key obligation of States parties (art. 33).

It is important to highlight article 33 of the newly adopted Convention on the Rights of Persons with Disabilities, which states that " States Parties shall ... maintain, strengthen, designate or establish within the State Party, a framework, including one or more independent mechanisms, as appropriate, to promote, protect and monitor implementation of the present Convention.

4. The Government of Azerbaijan highlighted that article 33(2) of the United Nations Convention on the Rights of Persons with Disabilities envisaged national mechanisms to promote, protect and monitor the implementation of the Convention.

64. In addition to designating institutions at government level tasked with implementation, the Convention requires States to maintain, strengthen, designate or establish a framework to " promote, protect and monitor " the implementation of the Convention.
64- إضافة إلى تعيين مؤسسات مكلفة بالتنفيذ على الصعيد الحكومي، تطلب الاتفاقية إلى الدول أن تقوم بحفظ أو تعزيز أو تعيين أو إنشاء إطار عمل لتعزيز هذه الاتفاقية وحمايتها ورصد تنفيذها().

(b) The framework established or designated must be capable of adequately carrying out its mandate to promote, protect and monitor the implementation of the Convention.
