138. The mandate of the Special Rapporteur on the independence and impartiality of the judiciary, jurors and assessors and the independence of lawyers was established by the Commission in its resolution 1994/41.

This principle is enunciated in the Draft Declaration on the Independence and impartiality of the judiciary, Jurors and Assessors and the Independence of Lawyers, also known as the Singhvi Declaration. (E/CN.4/Sub.2/1988/20/Add.1.) Principle 26 (b) of this Declaration states:

Summary At its sixty-first session, the Commission on Human Rights referred to the continuing study on the issue of the administration of justice through military tribunals in two mutually complementary resolutions, 2005/30, " Integrity of the judicial system " , and 2005/33, " Independence and impartiality of the judiciary, jurors and assessors and the independence of lawyers " , both adopted on 19 April 2005.
