As the 1994 Guide acknowledges, there was an overlap in the 1994 Model Law in the conditions for use of two-stage tendering, request for proposals and competitive negotiations and no rules that would establish a hierarchy among them.
فكما يقرّ دليل عام 1994، كان هناك تداخل في القانون النموذجي لعام 1994 في شروط استخدام المناقصة على مرحلتين وطلب الاقتراحات والتفاوض التنافسي، ولم تكن هناك قواعد لإرساء تراتبية فيما بينها.

The provisions of 1994 article 19 have become the basis for formulating the conditions for use of three procurement methods in the 2011 Model Law: two-stage tendering, request for proposals with dialogue and competitive negotiations.
66- أصبحت أحكام المادة 19 من نص عام 1994 الأساس في صياغة شروط استخدام ثلاث طرائق اشتراء في القانون النموذجي لعام 2011، وهي المناقصة على مرحلتين وطلب الاقتراحات المقترن بحوار والتفاوض التنافسي.

National legislation does not provide for such procurement methods as restricted tendering, request for proposals without consecutive negotiations, request for proposals with dialogue, request for proposals with consecutive negotiations, competitive negotiations or electronic reverse auction.
ولا ينص القانون الوطني على طرائق اشتراء من قبيل المناقصة المحدودة، وطلب الاقتراحات غير المقترن بمفاوضات متعاقبة، وطلب الاقتراحات المقترن بحوار، وطلب الاقتراحات المقترن بمفاوضات متعاقبة، أو التفاوض التنافسي، أو المناقصة الإلكترونية.

As noted in paragraph 64 above, the 2011 text largely eliminated the overlap in the 1994 conditions for use of two-stage tendering, request for proposals and competitive negotiations.
67- وكما وردت الإشارة في الفقرة 64 أعلاه، فإنَّ نصّ عام 2011 أزال إلى حد كبير التداخل في شروط عام 1994 لاستخدام المناقصة على لمرحلتين وطلب الاقتراحات والتفاوض التنافسي.

الفصل الخامس- إجراءات المناقصة على مرحلتين، وطلب الاقتراحات المقترن بحوار، وطلب الاقتراحات المقترن بمفاوضات متعاقبة، والتفاوض التنافسي، والاشتراء

They however are not applicable to some procurement methods, such as to request for quotations where correction of arithmetical errors would be prohibited under article 46 (2) [**hyperlink**], and to request for proposals with consecutive negotiations where they would simply be irrelevant since the financial aspects of proposals are crystallized during negotiations.
بيد أنَّ تلك الأحكام لا تنطبق على بعض طرائق الاشتراء، مثل طلب عروض الأسعار حيث يكون تصحيح الأخطاء الحسابية محظورا بموجب المادة 46 (2) [**وصلة تشعُّبية**]، وطلب الاقتراحات المقترن بمفاوضات متعاقبة حيث لا تكون تلك الأحكام ذات صلة نظرا لأنَّ الجوانب المالية للاقتراحات تتبلور أثناء المفاوضات.

سابعاً- المواضيع التي ينبغي تناولها في لوائح الاشتراء في سياق طرائق الاشتراء المُشار إليها في الفصل الخامس من القانون النموذجي (إجراءات المناقصة على مرحلتين، وطلب الاقتراحات المقترن بحوار، وطلب الاقتراحات المقترن بمفاوضات متعاقبة، والتفاوض التنافسي، والاشتراء من مصدر واحد) [**وصلة تشعُّبية**]

3. In view of many similarities in conditions for use and features of two-stage tendering and request for proposals with dialogue, the procurement regulations should pay particular attention to clarifying the purpose of the use of this method as opposed to two-stage tendering.
3- وبالنظر إلى أوجه التشابه الكثيرة في شروط استخدام المناقصة على مرحلتين وطلب الاقتراحات المقترن بحوار وفي سماتهما، ينبغي أن تولي الجهة المشترية اهتماما خاصا لتوضيح الغرض من استخدام هذه الطريقة بدلا من المناقصة على مرحلتين.
