وهكذا فإن دولا كثيرة تحمي المدين بالمستحق بالنص على أن تبرّأ ذمة المدين بالمستحق بالسداد وفقا للعقد الأصلي إلى أن يتلقى إشعارا بالإحالة وبأي تغيير في الشخص أو العنوان الذي ينبغي توجيه السداد إليه.

As to draft article 19, paragraph 6, the view was expressed that the current text might result in impairing the effectiveness of partial assignments, as it left to the debtor the choice of paying either in accordance with the notification or in accordance with the original contract.

The reference to payment " in accordance with the original contract " , rather than to payment to the assignor, is intended to preserve any payment agreement between the assignor and the debtor (e.g. payment to a bank account or address, or payment to a third person ).
والقصد من الاشارة الى السداد " وفقا للعقد الأصلي " بدلا من السداد الى المحيل، هو المحافظة على أي اتفاق للسداد بين المحيل والمدين (كالسداد الى عنوان أو حساب مصرفي أو الى شخص ثالث).

In addition, it was observed that, under the proposed combination of paragraph 5 and the proposed paragraph 5 bis, in the case of an assignment from A to B, from B to C and from C to D, if only B gave notification, the debtor would be discharged by paying B; and if D gave notification but not B or C, the debtor would be discharged by paying in accordance with the original contract.
ولوحظ اضافة الى ذلك أنه، بموجب الدمج المقترح للفقرة 5 والفقرة 5 مكررا المقترحة، وفي حالة اجراء إحالة من " ألف " الى " باء " ، ومن " باء " الى " جيم " ، ومن " جيم " الى " دال " ، ستُبرأ ذمة المدين بالسداد الى " باء " اذا كان " باء " وحده هو الذي وجه الإشعار؛ أما اذا كان " دال " هو الذي وجَّه الإشعار وليس " باء " أو " جيم " ، فان ذمة المدين ستبرأ بالسداد وفقا للعقد الأصلي.
