2. An organ includes any person or entity which has that status in accordance with the internal law of the State.
2 - يشمل الجهاز أي شخص أو كيان له ذلك المركز وفقا للقانون الداخلي للدولة.

Draft article 4 provides that the conduct of State organs acting in that capacity shall be considered to be acts of the State; and that the category of State organs includes any person or body which has that status in accordance with the internal law of the State.
ينص مشروع المادة 4 على أن تصرف أجهزة الدولة بتلك الصفة يعد فعلا قامت به الدولة؛ وأن فئة أجهزة الدولة تشمل أي شخص، أو هيئة، له أو لها ذلك المركز وفقا للقانون الداخلي للدولـــــة.

2. For the purposes of paragraph 1, an organ includes any person or body which has that status in accordance with the internal law of the State.
2- لأغراض الفقرة 1، يشمل الجهاز أي شخص له ذلك المركز أو أية هيئة لها ذلك المركز وفقا للقانون الداخلي للدولة.

Article 10 indicates that an organ may act in its capacity as such, notwithstanding that it “exceeded its competence according to internal law or contravened instructions concerning its activity”.
وتشير المادة ١٠ إلى أن الجهاز يمكن أن يتصرف بصفته تلك، حتى ولو كان " قد تجاوز ]...[ حدود صلاحياته وفقا للقانون الداخلي أو خالف التعليمات المتعلقة بنشاطه " .

This Convention does not exclude any criminal jurisdiction exercised in accordance with internal law.
لا تستثني هذه الاتفاقية أي ولاية قضائية جنائية تمارس وفقا للقانون الداخلي.
