واذا تعذّر على تلك الدول الأطراف، بعد ستة أشهر من تاريخ طلب التحكيم، أن تتفق على تنظيم التحكيم، جاز لأي من تلك الدول الأطراف أن تحيل النـزاع الى محكمة العدل الدولية بطلب وفقا للنظام الأساسي للمحكمة.

In this regard, it is of fundamental importance that written contractual agreements are prepared in conformity with the Statute of the Court, its immunities and privileges.
وفي هذا الصدد، فإن مما له أهمية أساسية أن تعد اتفاقات العقود الكتابية وفقا للنظام الأساسي للمحكمة وحصاناتها وامتيازاتها.

The Tribunal will therefore not have enough judges to fill the positions of President and Presiding Judge since, according to the Statute, ad litem judges are not eligible for election to these positions.
لذلك لن يكون لدى المحكمة الدولية ما يكفي من القضاة لشغل منصبي الرئيس ورئيس القضاة حيث إنه لا يجوز، وفقا للنظام الأساسي أن ينتخب القضاة المخصصون في تلك المناصب.
