The Court has jurisdiction in accordance with this Statute with respect to the following crimes:
تختص المحكمة وفقا لهذا النظام اﻷساسي بالنظر في الجرائم التالية:

1. The Court is a permanent institution open to States Parties in accordance with this Statute.
١ - المحكمة مؤسسة دائمة مفتوحة للدول اﻷطراف وفقا لهذا النظام اﻷساسي.

2. The Mechanism shall have primacy over national courts in accordance with the present Statute.
2 - تكون للآلية أسبقية على المحاكم الوطنية وفقا لهذا النظام الأساسي.

(a) Staff members shall be granted such fixed-term and short-term appointments that are consistent with the present Regulations as the Registrar or the Prosecutor, as appropriate, may prescribe.
البند 4/5 (أ) يعين الموظفون لمدد محددة أو بصفة مؤقتة وفقا لهذا النظام الأساسي حسبما يقرر المسجل أو المدعي العام، حسب المقام المناسب.

Any person implicated under this Statute shall remain free during the proceedings, unless he is placed under judicial supervision or taken into custody prior to the judgement, in accordance with the rules and conditions set forth below.
كل شخص يتهم وفقا لهذا النظام اﻷساسي يظل طليقا أثناء المحاكمة، ما لم يوضع تحت المراقبة القضائية أو يحتجز قبل صدور الحكم، وذلك وفقا للقواعد والشروط الواردة أدناه.

After it has heard the arguments of the Prosecutor and the State or person concerned, it can either confirm its decision of inadmissibility or authorize the Prosecutor to initiate a prosecution before it in accordance with this Statute.
وبعد الاستماع إلى حجج المدعي العام والدولة والشخص المعني، لها أن تؤكد قرار عدم المقبولية، أو أن تأذن للمدعي العام بالشروع في الملاحقات أمامها وفقا لهذا النظام اﻷساسي.

States Parties shall undertake to extradite to the Court any fugitive requested for extradition and found in their territories in accordance with this Statute and their national laws.
تتعهد الدول اﻷطراف بأن تسلم الى المحكمة، وفقا لهذا النظام اﻷساسي ولقوانينها الوطنية، أي مجرم هارب تطلب المحكمة تسليمه ويكون موجودا في أراضيها.

2. The Chamber shall ensure that a trial is fair and expeditious and is conducted in accordance with this Statute and the Rules, with full respect for the rights of the accused and due regard for the protection of victims and witnesses.
٢ - تكفل الدائرة أن تكون المحاكمة عادلة وسريعة وتجري وفقا لهذا النظام اﻷساسي وللقواعد، مع احترام حقوق المتهم احتراما كاملا وإيلاء الاعتبار الواجب لحماية المجني عليهم والشهود.

1. The Procuracy is an independent organ of the Court responsible for the investigation of complaints brought in accordance with this Statute and for the conduct of prosecutions.
١ - هيئة الادعاء جهاز مستقل من أجهزة المحكمة مسؤول عن التحقيق في الشكاوى المقدمة وفقا لهذا النظام اﻷساسي وعن مباشرة الادعاء.

1. Notwithstanding article 21, the Court has jurisdiction in accordance with this Statute with respect to crimes referred to in article 20 as a consequence of the referral of a matter to the Court by the Security Council acting under Chapter VII of the Charter of the United Nations.
١ - مع عدم اﻹخلال بالمادة ٢١، تختص المحكمة وفقا لهذا النظام اﻷساسي بالجرائم المشار إليها في المادة ٢٠ إذا قرر مجلس اﻷمن لدى مباشرته لعمله وفقا للفصل السابع من ميثاق اﻷمم المتحدة إحالة الموضوع إليها.

An accused shall be presumed innocent [until] [unless] [proved guilty] [convicted] in accordance with [this Statute] [law]. [The onus is on the prosecutor to establish the guilt of the accused [beyond reasonable doubt].] [Note 1.
يفترض أن المتهم بريء ]الى أن[ ]ما لم[ ]يثبت ذنبه[ ]يحكم بإدانته[ وفقا ]لهذا النظام اﻷساسي[ للقانون. ]ويقع على المدعي عبء إثبات ذنب المتهم ]دون أي شك معقول[.[

2. The Chamber shall ensure that a trial is fair and expeditious and is conducted in accordance with this Statute and the rules, with full respect for the rights of the accused and due regard for the protection of victims and witnesses.
٢- تكفل الدائرة أن تكون المحاكمة عادلة وسريعة وأن تجري وفقا لهذا النظام اﻷساسي وللائحة، مع احترام حقوق المتهم احتراما كاملا وإيلاء الاعتبار الواجب لحماية المجني عليهم والشهود. المادة ٧٥

" 2. States Parties shall undertake to extradite to the Court any fugitive requested for extradition and found in their territories in accordance with this Statute and their national laws.
" ٢ - تتعهد الدول اﻷطراف بأن تسلم الى المحكمة أي شخص هارب مطلوب تسليمه ويعثر عليه في اقاليمها وفقا لهذا النظام اﻷساسي ولقوانينها الوطنية.

Any ambiguity in the wording of article 3, paragraph 3, could be clarified by adding the words “in accordance with this Statute” after “State Party”.
واختتم قائلا أن أي غموض في صياغة الفقرة ٣ من المادة ٣ ، يمكن توضيحها بإضافة العبارة " وفقا لهذا النظام اﻷساسي " بعد عبارة " أي دولة طرف " .

The Court shall have jurisdiction in accordance with this Statute with respect to the following crimes: the crime of genocide, crimes against humanity, war crimes and the crime of aggression, whose elements will be adopted by the Assembly of States Parties.” Such a formulation would refocus participants’ attention on the expectations of the international community.
وينبغي للمحكمة أن يكون لها اختصاص وفقا لهذا النظام اﻷساسي فيما يتعلق بالجرائم التالية : " جريمة الابادة الجماعية والجرائم ضد الانسانية وجرائم الحرب وجريمة العدوان ، التي سوف تعتمد أركانها من جمعية الدول اﻷطراف " . ومثل هذه الصيغة سوف تعيد تركيز اهتمام المشتركين على توقعات المجتمع الدولي .

After it has heard the arguments of the Prosecutor and the State or person concerned, it may either find that the conditions of article 35 (a) have been fulfilled or authorize the Prosecutor to initiate a prosecution in accordance with this Statute.
وبعد الاستماع إلى حجج المدعي العام والدولة أو الشخص المعني، ولها أن تعتبر أن الشروط التي تنص عليها الفقرة )أ( من المادة ٣٥ لا تزال قائمة، أو تأذن للمدعي العام بالشروع في الملاحقات وفقا لهذا النظام اﻷساسي.

" The Court is a permanent institution open to States parties in accordance with this Statute. [In accordance with the provisions of this Statute] It shall act when required to consider a case submitted to it. "

At any stage of the procedure involving a person covered by article 1, paragraph 2, of this Statute, the Mechanism may formally request national courts to defer to its competence in accordance with the present Statute and the Rules of Procedure and Evidence of the Mechanism.
ويجوز للآلية، في أي مرحلة من مراحل الدعوى التي تشمل شخصا تسري عليه أحكام الفقرة 2 من المادة 1 من هذا النظام الأساسي، أن تطلب رسميا إلى المحاكم الوطنية التنازل لها عن اختصاصها وفقا لهذا النظام الأساسي وللقواعد الإجرائية وقواعد الإثبات للآلية.

At any stage of the procedure involving a person covered by Article 1, paragraph 2 of this Statute, the Mechanism may formally request national courts to defer to its competence in accordance with the present Statute and the Rules of Procedure and Evidence of the Mechanism.
ويجوز للآلية، في أي مرحلة من مراحل الدعوى التي تنطوي على شخص مشمول بالفقرة 2 من المادة 1 من هذا النظام الأساسي، أن تطلب رسميا إلى المحاكم الوطنية التنازل لها عن اختصاصها وفقا لهذا النظام الأساسي وللقواعد الإجرائية وقواعد الإثبات للآلية.

At any stage of the procedure involving a person covered by Article 1 paragraph 2 of this Statute, the Mechanism may formally request national courts to defer to its competence in accordance with the present Statute and the Rules of Procedure and Evidence of the Mechanism.
ويجوز للآلية، في أي مرحلة من مراحل الدعوى التي تنطوي على شخص مشمول بالفقرة 2 من المادة 1 من هذا النظام الأساسي، أن تطلب رسميا إلى المحاكم الوطنية التنازل لها عن اختصاصها وفقا لهذا النظام الأساسي وللقواعد الإجرائية وقواعد الإثبات للآلية.

In that same paragraph, the concern expressed by the United Arab Emirates might be met by inserting “in accordance with this Statute” or “under this Statute” to make it clear that the reference was to the powers given by the Statute.
وفي الفقرة ذاتها ، فإن الشاغل الذي يقلق اﻹمارات العربية المتحدة يمكن تلبيته بإدراج عبارة " وفقا لهذا النظام اﻷساسي " أو " بمقتضى هذا النظام اﻷساسي " لتوضيح أن اﻹشارة تقصد السلطات التي يمنحها النظام اﻷساسي .
