24. with regard to draft article 7, the determination of predominant nationality was a subjective question. In practice, any State whose nationality was invoked by a person with dual or multiple nationality might claim that its nationality was predominant, since there were no established criteria in international law to determine the predominance of one nationality over any other.
24 - وفيما يتصل بمشروع المادة 7، فإن البتّ في الجنسية الغالبة يعد مسألة ذاتية وفي مجال الممارسة فأي دولة يحتج شخص ما بجنسيتها فيما يكون حاصلا على جنسية مزدوجة أو جنسيات متعددة يمكن أن تدعي بأن جنسيتها هي الغالبة باعتبار أن ليس ثمة معايير مستقرة في القانون الدولي لتحديد غلبة جنسية ما على أخرى.

63. with regard to draft article 11, on the protection of shareholders, the negative wording which had been adopted was satisfactory, as were the cases envisaged in that exception to the general rule, which, according to the commentary, should be interpreted in a restrictive manner in order to prevent a plethora of international claims by different States.

69. with regard to draft article 8, he noted that the cases of refugees and stateless persons were dealt with in the relevant international conventions and treaties, but those international legal instruments did not deal directly with diplomatic protection of that category of persons; in fact, they appeared implicitly to exclude them.

34. with respect to draft article 7, " Multiple nationality and claim against a State of nationality " , while understanding the purpose and practical implications of the provision regarding predominant nationality, his delegation believed that there was no clear definition of " predominant nationality " in international law, and it was difficult to judge in practice.

as to draft article 9, dealing with notification of intention to terminate or withdraw from a treaty or to suspend its operation, it provided an additional guarantee of the stability of treaties.

58. concerning draft article 4, the intention of the parties was a crucial factor in determining the susceptibility of a treaty to termination or suspension when the treaty itself contained no provisions on the matter and when the travaux préparatoires, the context in which the treaty had been concluded and the nature of the treaty shed no light on the subject.
58 - وفيما يتصل بمشروع المادة 4 أوضح أن نية الأطراف تشكِّل عاملاً جوهرياً في تحديد إمكانية إنهاء أو تعليق معاهدة ما عندما لا تحتوي المعاهدة ذاتها على أحكام بشأن المسألة وعندما لا تُلقي الأعمال التحضيرية ولا سياق المعاهدة الذي أُبرمت فيه ولا طبيعة المعاهدة ذاتها أية أضواء على الموضوع.
