The State party first recalls its obligations under article 3 of the Convention, and recalls that the Committee has specified the conditions of application of this provision in its jurisprudence and in its general comment No. 1 of 21 November 1997.

in its general comment No. 23, it had established that it was not for a State alone to decide which groups constituted minorities so as to claim minority rights, but rather that that decision should be based on objective criteria, an issue of great importance to those religious minorities denied recognition as minorities and on that basis denied their rights.

in its general comment No. 5 (1994) on disability, the Committee defined the rights of persons with disabilities and made explicit reference to their right to physical and mental health, which implied the right to have access to, and to benefit from, those medical and social services that would enable them to sustain and reach their optimum level of independence and functioning.

in its general comment No. 31, the Human Rights Committee indicated that States Parties to the Covenant were under an obligation to abstain from transferring an individual, by means of expulsion, extradition or otherwise, to a State where he or she would be at risk of " irreparable harm " or from where he or she would be transferred to another country in which he or she would face the same risk.
