The main purpose of this Opinion is to show that, not generally but always, the threat or use of nuclear weapons would be contrary to the rules of international law and, in particular, to the principles and rules of humanitarian law.
والغرض الرئيسي من هذه الفتوى هو بيان أن استخدام اﻷسلحة النووية والتهديد باستخدامها يكون دائما وليس بصورة عامة مخالفا ﻷحكام القانون الدولي ولا سيما مبادئ وقواعد القانون اﻹنساني.

83. It has been maintained in these proceedings that these principles and rules of humanitarian law are part of jus cogens as defined in Article 53 of the Vienna Convention on the Law of Treaties of 23 May 1969.
٨٣ - ودفع في هذه الدعوى بأن مبادئ وقواعد القانون اﻹنساني هذه هي جزء من القواعد اﻵمرة على نحو ما عرﱠفتها المادة ٥٣ من اتفاقية فيينا لقانون المعاهدات المؤرخة ٢٣ أيار/ مايو ١٩٦٩.

" ثانيا، أعلنت محكمة العدل الدولية في عام ٦٩٩١ أن `التهديد باﻷسلحة النووية أو استخدامها إنما هو عموماً أمر مخالف لقواعد القانون الدولي السارية في النزاعات المسلحة، وبشكل خاص مبادئ وقواعد القانون اﻹنساني`.

وتستشهد المحكمة بجملة أمور منها حكم مارتنز " كتأكيد لانطباق مبادئ وقواعد القانون اﻹنساني على اﻷسلحة النووية " )الفقرة ٧٨(.

It will first address the question whether there are specific rules in international law regulating the legality or illegality of recourse to nuclear weapons per se; it will then examine the question put to it in the light of the law applicable in armed conflict proper, i.e. the principles and rules of humanitarian law applicable in armed conflict, and the law of neutrality.
وستولي اهتمامها أولاً لمسألة ما إذا كانت هناك قواعد محددة في القانون الدولي تنظﱢم مشروعية أو عدم مشروعية اللجوء إلى اﻷسلحة النووية بالذات؛ وستنظر بعد ذلك في المسألة المعروضة عليها في ضوء القانون الساري في النزاع المسلح بمعناه الفعلي، أي مبادئ وقواعد القانون اﻹنساني المنطبقة في أوقات النزاع المسلح، وقانون الحياد.

The advisory opinion issued by the International Court of Justice on 8 July 1996 on the legality of the threat or use of nuclear weapons breaks new legal ground in clearly establishing that such actions “would generally be contrary to the rules of international law applicable in armed conflict, and in particular the principles and rules of humanitarian law”.
وتبدأ الفتوى التي أصدرتها محكمة العدل الدولية بشأن شريعة التهديد باﻷسلحة النووية أو باستخدامها عملاً قانونياً جديداً بأن تقرر بوضوح " أن التهديد باﻷسلحة النووية أو باستخدامها يتعارض بصفة عامة مع قواعد القانون الدولي المنطبقة في النزاع المسلح، وخاصة مع مبادئ وقواعد القانون اﻹنساني " .

60. All rules relating to privacy and property rights shall be in strict conformity with international human rights and humanitarian law norms.
60- يجب أن تكون جميع القواعد المتعلقة بالخصوصيات وحقوق الملكية متفقة تماماً مع قواعد قانون حقوق الإنسان الدولي وقواعد القانون الإنساني الدولي.

61. All rules pertaining to the rights of association and assembly shall be in strict conformity with international human rights and humanitarian law norms.
61- يجب أن تكون جميع القواعد ذات الصلة بحقي التجمع وتكوين الجمعيات متفقة تماماً مع قواعد قانون حقوق الإنسان الدولي وقواعد القانون الإنساني الدولي.

Every State has the obligation to respect, ensure respect for and enforce international human rights and humanitarian law norms that are, inter alia:
