Reaffirming the Charter of the United Nations, in particular articles 101 and 97,

Secondly, it is necessary to recall that the General Assembly, which, under the Charter, in particular articles 10 and 11, is competent to deal with the maintenance of international peace and security, has not been in a position to exercise that competence — not because of a lack of a legal framework but because the predominant political will was that it should not make use of that capacity.
وثانيا، من الضروري أن نذكر بأن الجمعية العامة، وهي الهيئة المختصة بصون السلم واﻷمن الدوليين وفقا للميثاق، ولا سيما المادتان ١٠ و ١١ منه، لم تتمكن من ممارسة تلك الصلاحية - ليس بسبب عدم وجود إطار قانوني، بل ﻷن الارادة السياسية السائدة كانت تقتضي بعدم استعمال تلك الصلاحية.

At the same time, we must note that the approach to the report of the Security Council to the General Assembly must be in accordance with the dictates of the Charter, particularly articles 11 and 12, which provide for a kind of harmony between the powers and the status of the principal organs of the United Nations, including between the General Assembly and the Security Council.
ويجب أن نلاحظ في الوقت نفسه أن الموقف من تقرير مجلس اﻷمن المقدم إلى الجمعية العامة يجب أن يتوافــق مــع ما تمليــه مواد الميثاق، ولا سيما المادتان ١١ و ٢١، اللتان تنصان على قيام نوع من الانســجام بيــن سلطات ومراكز اﻷجهزة الرئيسية لﻷمم المتحدة، بما في ذلك الجمعية العامة ومجلس اﻷمــن.

The State party should amend, as a matter of priority, the relevant provisions of the Criminal Code, particularly articles 201 bis and 425, in order to legally define torture in accordance with article 1 of the Convention, and criminalize it in accordance with article 4, paragraph 2, of the Convention.
