٤٣- أما عن حق الطفل ووالديه في مغادرة ودخول بلدهم العراق، فقد ضمن قانون جوازات السفر المرقم ٥٥ لسنة ٩٥٩١ وتعديلاته آخره نظام ٩١١ لسنة ٧٨٩١، السماح لكل عراقي بالسفر واصطحاب زوجته وأطفاله معه تنفيذاً لما ورد في المادة ٤٢ من الدستور التي نصت على " لا يجوز منع المواطن من السفر خارج البلاد أو من العودة إليها ولا يقيﱠد تنقله أو إقامته داخل البلاد إلا في الحالات التي يحددها القانون " .
